One of the couples did have their FP refused and still came through.... However I don't know the technicality of their refusal of FP. As EEA Family Member he can open a current or joint account with valid visa no matter which one.
My non-EU wife received NIN showing our marriage certificate and Dependent stamp ink only. (issued after appeal), In our case bank not recognised Dependant Ink Stamp as valid visa unfortunately.
