Re: Which route to take to Sue the Home Office

Continue the fight - don't give up no matter how long it takes. I would also be concerned if the involved officers have continued working as clearly they do not uphold the values of the HO and have therefore brought the HO reputation into disrepute - Corruption must end!! Thank you for your words o...

Re: Which route to take to Sue the Home Office

Further updates: Criminal charges have now reached the Magistrates Court after the Police disappointingly washed their hands from investigating the Officers. Settlement: Home Office doubled their offer but it was still a paltry offer. Barrister sent a detailed letter before a claim- and the Home Off...

Re: Which route to take to Sue the Home Office

Here's another case relating to Immigration Officers' abuse of power: Family visitor receives £125,000 damages for mistreatment by immigration officials > Radha Naran Patel v Secretary of State for the Home Department [2014] EWHC 501 (Admin) (30 July 2014) (unlawful actions and damages) *** UPDATE ...

Re: Which route to take to Sue the Home Office

It has been a while since I updated this thread. But there have been some significant developments. My complaint against the DVLA was upheld by the Ombudsman and I received compensation. But what was critical for us was the findings- the Ombudsman was brutal in their judgement against the DVLA and p...

Re: Which route to take to Sue the Home Office

Hi all. Another quick update. Home Office finally responded giving me the option of Escalating my complaint to the Ombudsman after my MP wrote to them so the matter is now with the Ombudsman. However they did not give any findings- they just gave me the option of Escalation. Tactical by them or what...

Re: Which route to take to Sue the Home Office

Unfortunately if some things don't get brought out in the press you don't get justice, that's the hostile environment we now live in. Recent press coverage of what happens at the brook house detention centre clearly shows what's going on and has been going on for heaven knows how long and the power...

Re: Which route to take to Sue the Home Office

Hi all. Just an update on my case. Following help from my MP- I managed to get a 'limited Subject Access Request' from the Home Office. But only up until the date of the raid. So they have ommitted some information on my file. In it is some damning information. They had the information on how I ente...

Re: Which route to take to Sue the Home Office

While I don't know exactly how you should pursue justice, I just wanted to say I would do the same thing if I were in your shoes (sue or press criminal charges, once the officers are identified). What happened to you and your family is really outrageous. Thank you. It really was barbaric behaviour ...

Re: Which route to take to Sue the Home Office

It's a pity for something like this to have happened. And it won't stop if many of us are scared to sue HO if they're wrong. Moreover, they did all of this in front of a minor. In my own opinion try and search the entire UK to look for a very compitent solicitor and it may involve few pound and I p...

Re: Which route to take to Sue the Home Office

It's difficult to make a rational decision when events like this get to you. What you need now is peace of mind hence my question whether or not it is worth pursuing the matter to get justice? I mean if you have been granted leave to remain or right to settle under EEA Law is it worth years of batt...

Re: Which route to take to Sue the Home Office

@khers Unfortunately my MP is indeed a Tory. That said, he has been very helpful and really pressed the Home Office on my behalf. From the correspondence he received (and FW to me) the Home Office : 1. Admit to a so called "hot tasked enforcement visit" 2. Admit to negligence of supposedly...

Re: Which route to take to Sue the Home Office

Have you resolved your immigration status. If you were issued leave under the Regulations, then you may have a case under EU law. Not sure the nature of the convention rights breach. I won my appeal against removal and the First Tier Tribunal judge confirmed I meet the EEA regulations. I have since...

Unless they are suggesting you obtaining entry by deception.
Yes, it was an unlawful removal with Human Rights Violations. Hence me wanting to escalate it to litigation.

Re: Which route to take to Sue the Home Office

You need to answer my question. I am not judging you or anything. I am just seeking to establish why they did this. I was only issued a Search warrant during the raid and no removal directions were set, just verbal confirmation of their intention to detain and remove me. However when I went for my ...

Re: Which route to take to Sue the Home Office

Hi Obie. Thank you for your response. Yes my son holds British citizenship by descent through my wife and he witnessed his old man being brutalised. As I mentioned in my original post, I was issued an EEA1 ink stamp for 6 months which was still in date at the time of the raid. "Have you been is...

Which route to take to Sue the Home Office

Hi all. I am in a bit of a pickle as to the right route to take here. In April this year, the Home Office attempted to remove me. It was a brutal raid in front of my toddler while we were in the middle of a shower. A brief background to the story is this: - Entered UK in December after 10 months in ...
