Re: ILR or further FLR (M) extension

Although, it will be expensive but apply for FLR(M) and once you complete the qualifying time, send a letter to the Home Office requesting to vary your application to SET (M), (Forward them your Life in the UK and B1 English test as well). They will most probably vary it to SET (M). Best of luck wit...

Re: ILR or further FLR (M) extension

In my opinion, you might have two options. First, apply for FLR (m) and after the qualifying period, vary it to SET (M). Or apply for SET (M) and explain in the covering letter, but this will be very risky as it will be the discretion of the Home Office to accept it or not. So although it will be ex...

Re: Frist Spouse Visa from Pakistan Documentation Check

Hi everyone, Sorry to interrupt but are we not supposed to scan the documents to the VFS website? Also, in the new system, you cannot book the appointment unless you upload something. Can we upload it on later date? Do we have to upload it before the appointment? The guidance says that the sponsor n...

Re: ILR SET(O) - confirmation email

The booking is made in UKVCAS website and therefore, it does not show on the application page. Make sure you take the documents checklist form and declarations otherwise your application will be get submitted. Also, upload your documents to save your time at the appointment. Good luck.

Re: EEA PR but divorce in process

I am extremely confused by your case, on the one hand, you are sponsoring a wife overseas. On the other hand you are about to get a divorce from an EEA national. What is the actual case. https://www.immigrationboards.com/immigration-for-family-members/spouse-entry-clearance-employer-questions-t2624...

Re: EEA PR but divorce in process

Is she working at all in the UK? You can ask the Home Office to check, if they refuse, you can apply for a witness summon for her to come to court. Can we ask the Home Office to check????? Can you possibly give me the relevant law or article where I can ask the Home Office to make investigations of...

Re: EEA PR but divorce in process

However a huge problem is ahead of you in relation to the ID and her treaty rights documents. You could apply for a witness summon in this case, in the event of the matter going to the tribunal. Some EEA national are not always helpful, when you force them to come to the tribunal to give evidence t...

It is legally possible for a person to apply under Regulation 15(1)(b), even if they have not received a decree absolute.
Thanks Obie for the citation. I will check the regulation. Your help is highly appreciated.

See also Immigration breaches and people who have sought asylum in the UK , etc. Thank you very much for prompt response. It says that if the person comes to the UK as minor then discretion can exercised to waive the immigration breach (Page 26), does it mean it will not apply to minor who was mino...

Re: BRP wait time after succesful appeal

Oh. You can only wait. There is not time limit I think when it comes the Home Office. One of my friend got his BRP after 8 months, when he sent Pre-Action Protocol to them. So I think there is no time limit. Just wait and send them reminders every now and then.

Re: Registration as British Citizen after ILR on Refugee status

What is the UK Immigration status of the other parent? If the mother can't naturalise and the other parent is not British, it is unlikely that the child will be registered as a British citizen. If he is close to 18, he may want to naturalise after his 18th birthday, though of course he will need to...
