Re: permanent Leave To Remain REFUSED - Child affected

Hi all, thanks for your reponses. This is a very helpful site. The mother is from the Carribean so not sure if the Hague convention applies. I tried to apply for a British passport but the passport office turned be down because the mother already has one. I thought that she was not allowed to get a...

perhaps he left the UK before the first concession was announced hence the refusal. If he left the UK before the 15th of March and decision made after the 1st of April, there was every likelihood that the application would have been rejected under paragraph 320. However, despite having left before t...

The problem Twin has, is that he/she always wants the better pill sugar coated and as Frontier Mole has pointed out he is very pragmatic about his answers. Which I think is fair and honest. As for SYH, well, he/she was just blatantly rude, and nothing like Frontier Mole! Aside your day job, are you...

Your lawyer should write to the consulate and ask them to reconsider quoting the recently announced concession 15th of may as referred to by Vinny above.

In the meantime, you might think of putting in a new application on this basis also.

It is an indictment on the human race when the sanctity of life especially that of an innocent child takes second place to politics, and economics. Justice (and immigration policy) should be tempered with mercy, it is easy for people who are born into a developed country through no effort of their ...

Hi Twin, thanks for your response. I have prohibited steps in place thank goodness. The even said she could still slip out of the country. A lot of confidence that gives me. I have served orders on a family member but the judge said that it is more effective to serve on mother. And that there is no...

Thank you for your responses. most appreciated. If I could give you some background to put in perspective because it is a bit more complicated. Mother was initially a student. Got married and Home Office gave her 2 years to live in the country. They also gave my son 2 years at the same time. Son bo...

Very cruel of the home office and the judge! Paragraph 248 of the Immigration rule should have applied at the time of appeal if not at decision stage by the home office. This is where I find this particular rule discriminatory. A mother usually have residence of her child but had it being the father...

Re: Girlfriend Overstayed

In that case there is a lot of hope for her return! All she was issued with I suppose, was an IS151A which means if she applies for the visa before the 1st of October, she shouldn't be banned for overstaying. I think you should get your skates on and apply asap (provided you have all documents intac...

Re: Girlfriend Overstayed

reading this breaks my heart and almost brought me to tears (maybe i'm just hopelessly emotional). It's such a shame that she was removed. Given the new rules, i'm thinking it would be difficult but not impossible. Your best bet might be to forge ahead with the spousal visa application and if refuse...

But the new rules are designed in such a way that it restricts the power of the Immigration Judges. So AIT will be definitely busy but the homeoffice will win most of the cases as these new laws are mandatory refusals and restricts Judges' descretion. So Liam Byrne has done very good job in draftin...

Well Twin, According to Liam Byrne they're supposed to benefit. His letter to ILPA continues: I covered the issue of people being served with enforcement decisions while leaving the UK when I wrote to you on 29 February. People who are leaving voluntarily should generally be served with form IS151A...

My worry is that Liam Byrne's assurance of an "amnesty" period seems to be couched in ambiguity. ECOs may therefore believe that they are applying 320 (7B) correctly. Note the following extract from his letter to ILPA: You will be aware that paragraph 320 of the Immigration Rules only app...

IS151B

Just for clarification purporses, can someone confirm that being served an IS151B after a failed application or at the point of departure does not get a 10 years ban if the person leaves voluntarily? I have read the UKvisas guidelines and Liam Byrne's letter to ILPA and these seem to confirm that ge...

Having read what's posted here, and now the refusal notice, what it actually boils down to is what you got served. If you got served an IS151B, then the ECO followed the rules by imposing the 10 year ban. The only way to take advantage of the concession is if you left voluntarily or if you only got...

Quite contrary, my appeal was allowed because of this. Had he been here long enough to acquire the righ...

Hi Twin, You pose a very interesting question. As I read it (7a) would be if you had used someone to represent you and submitted false documents or false information on your behalf. This would apply to any application every by the applicant. If an applicant is refused under paragraph 320(7A), do th...
