Anyway, does anyone know how long consultation takes before it is implemented? surely if the "exercising rights of access to a child" rule is abolished, it would affect immigrant families. I have scouted the internet and wasn't even able to find the so called consultation... This is all I...

Okay no takers on this one thus far. Let me try and clarify my question. Before the new 320(7B) came into effect on 1 April 2008 ECO could refuse entry clearance for overstaying using their discretion . But now refusal under 320(7B) is automatic with a ban unless 320(7B) does not apply. Has this re...

Scrapping "Rights Of Access To A Child"

Please people, help me make sense of this: The points-based system will rationalise and simplify our existing system for controlling immigration by migrants who wish to work or study in the UK, so that only the migrants we need are allowed to come to Britain. The new system will not cover immigratio...

320(7B) doesn't apply to you, you didn't enter the UK illegally or overstay, you were simply refused a visa. There's no bar on you making an application. Given the passage of time and vastly different circumstances your application is unlikely to be prejudiced by the previous refusal. It's quite po...

You have got to be kidding me! Didn't you win your appeal last may? That is disgusting!! You should start a judicial review! Thanks for that, I'll have a look into this, I thought judicial review is the net step after you lost your appeal. Yes, I won appeal last May, got my passport stamped 1 year ...

I can't go the legacy route as I never claimed asylum. Apparently legacy route is not just for asylum cases but for human rights as well. And to think that have you applied for asylum you'd have most likely qualified under 2003 family amnesty. I never claimed asylum either so missed on that as well...

Oh Twin! I am sure that they can't forever bar me to be with my child. Not forever, but what if they still refuse and you have to appeal, which may take a whole year. Twin, did you check whether your case is a legacy case. I would have thought so, as you've been here for donkey years  and I t...

Oh Twin! I can see that you are tired and fed up of fighting. You still remember Jeff Albright?, He was able to defend himself and win the case, wish we had the knowledge and courage not to count on our lawyers. You have been in this country for years, Isn't it better for you to wait in a place tha...

Heneni, how about you call the local county court around your children's residence to get accurate information? You should also note down the name of the person you speak to at the court and ask them if you can refer your ex husband to them? You can then give your ex husband the name and telephone n...

Re: Application forms???

Heneni, since this application would be dealt with by the NCC2 department of the BIA, I think it's best to contact the UK (the specific department of course) to get more information on the right application form. As Kate also narrated, the ECOs know next to nothing about this kind of visa. You could...

Help me out of this Dilemma.

One of the requirements for the rights of access to a child visa is for me to be able to maintain myself and any dependants. I've run out of funds so I can't prove maintenance on my own having spent it all on legal fees. I can prove accomodation but haven't got didly squat in savings. Can my ex give...

This individual has not got a hope, you are encouraging someone to waste their resources and time in trying to win something that can not be won. By their own admission they accepted they have lied / deceived in an att...

It is merely a way of avoiding a mandatory refusal, which this forum calls a ban
Yeah, a mandatory refusal which also carries a ban. It's not one or the other, it's both at the same time. The forum not only calls it so, the HO says so.

Frontier Mole, Is it really true that receiving the IS151A closes one's "overstayer" chapter? Are you saying there's likely to be no questions asked regarding one's previous overstay? If that is the case, why then is there a "significantly contrived to frustrate the immigration rules&...

so long he initiates a court proceeding and has a letter from the court or a receipt to confirm that he has a pending case then it should be fine. He of course would have to prove that he supports the child by providing evidence of child support etc.
