Unfortunately, I could never guarantee anything 100 per cent. The worst case scenario is that they take offence at her attitude, and refuse on the grounds that she is untrustworthy and that granting her entry would be against the public good, or that they pick holes in something else...unfortunately...

Student visas do carry the right of appeal at the moment...but not for long.

I don't quite understand why she is wanting a visa for another country if she is in her final year at Uni. Sounds strange to me, and I guess it will for the ECO or an immigration judge.

There can be exceptions, but they are few and far between. Do you think that there are any special circumstances? Do you have a partner in the UK? Children? Anything in your home country which may assist an application to stay on compassionate grounds?

Sorry Sakura, but it is the case that no Certificate of Approval is needed to marry in the Church of England.

However, even if you do marry in the UK, this does not mean that a switch will be permitted, so a trip to Zimbabwe is likely to be needed anyway.

What are the exact dates of the visa and of her entry? If she was only one month late she may just get away with a ILR application. If not, then she can get a further period of leave for 2 years. She can apply either in the UK or the Philippines but it may be better for her to do it before she goes....

To answer what I think is your question - it doesn't matter if the two years living together spans two visas as long as they have been living together for the two years preceding the application. There can't be a significant gap.

If she admits to everything but refuses to name the employer to the Entry Clearance Officer, then I do not believe they can refuse to grant her entry because of that.

The only way anyone can switch from visitor to student is if they are from a non-visa national country and if the course they intend doing is degree level or above - and even this measure is closing at the end of August.

So, I agree - he will have to go home.

assuming that the only reason for refusal was that they did not believe she intended to return home after her visit, then I would say her application for the fiancee visa stands a good chance of success based on the information you have given here.
