Re: Online EEA PR and EU passport return service available

Hi all, does anyone know of any guidance or information having been issued on when with HO stop accepting applications for PR from EEA citizens (given Brexit and EU Settlement Scheme)? Will it stop on 31 January or will it remain open for applications until the end of the transition period (assuming...

New application during cutrailment period

Hi all, I am dealing with a situation whereby one of my clients Sponsorship Licence expired without their knowledge and subsequently the Tier 2 ICT visa of the sponsored employee was curtailed. Their Tier 2 ICT was issued in 2014, and was extended in 2017. The main holder also has Dependants with hi...

Re: Switching to a new employer on tier 2 visa.

They will need to send the Sposorship Licence application with a lot of documents such as audited annual accounts, evidence of Employers' Liability Insurance, bank accounts etc. It can take a number of weeks for this to be approved. Then, if approved, the Level 1 user will be sent log in details for...

Re: Switching from Tier 1 to Tier 2

Additionally you must fit the job description and the person specification used on the job advert. For example if the advert asked for PhD or Chinese langugage skills and you don't have these, they you shouldnt be assigned the CoS even though nobody else applied. Instead the advert needs to be re-ru...

Re: November 2017 Restricted COS

Hi all, I also have one more doubt, my job falls under shortage occupation list.. I was just reading online on HO site that jobs following under shortage occupation list doesn't need a Resident Labour market test.. But then I am not sure why my employer conducted it.. Can any one confirm my underst...

Re: How to Report to UKBA for Tier 2 employee visa change

You would expect that HO would know but they still expect sponsors to report this on SMS. Same goes for any sponsored workers who sucessfully apply for ILR. If sponsorship is not cencelled the sponsor does not comply with the reporting duties and puts the licence at risk. On SMS you have to go under...

Re: Tier 2 to ILR (start date and end date)

I am noy sure why you are surprised about the dates your visa was granted for, based on the information that was given. You said you would travel on 13 February so the visa was granted from beginning of February to give you some leeway to change your plans. The expiry is 14days after the end date yo...

Re: Tier 2 TUPE Liquidation (confused) Help

This is a tangle of employment law and immigration. If you have been made redundant you cannot at the same time TUPE transfer to the new employer - it is one or the other. Have you received any redundancy payment and notice payment when you got your redundancy letter? When did you actually stop work...

Re: November 2017 Restricted COS

Hmm, my employer submitted the application on Nov 1, RLMT was conducted properly this time and score comes out as 36. Any idea what could possibly be the hold up? Employer also tried emailing HO but no revert as of yet. I'm also guessing that allocation stats for this month come out on Monday, this...

Hi aokamgba,

Hi aokamgba,

Have you managed to see the approval from SMS portal ??
Yes we have seen it in SMS the next day, the RCOS has been assigned to the employee and she has now applied for her visa and has the appointment at the application centre on Monday.

Re: November 2017 Restricted COS

Hi guys, I have a question. When employer requests COS via SMS, do they just need to fill a request cos form on portal and if asked then submit documents to HO? Also once it's approved hopefully by 11th dec next month then make the payment of COS and ISC? Am I right? Thanks. Correct, when the emplo...

Re: Tier 2 ICT visa - have a new job with salary > £73900

You’ll need to have worked for your company for more than 12 months, unless they’re going to pay you £73,900 or more a year to work in the UK. But presumably one would still need to work for the employer abroad who is linked to the UK employer by the intra-company link, albeit not necessarily for f...

If RLMT was not conducted properly and they issued you a COS, your application would have been refused.

They will have to do the whole process again, for 28 days before offering you the job and issuing a CoS.
I thought Tier 4 switching into Tier 2 were exempt from RLMT?

Re: November 2017 Restricted COS

Yes, I am not really sure why it didn't go through the normal allocation as this is what I expected to happen. In terms of points I believe for completed RLMT and salary £36k the application scored 20 + 16 = 36 points. But in all previous months allocations the minimum for allocation was 21 points ...

Re: November 2017 Restricted COS

We just received the approval as well. I am currently relying on an email sent to the AO as the website seems to be down and I cannot log into the SMS to double check. The RCOS application was submitted on 5 November and we got the response via email 6.37am today. The email says "Your applicati...

Re: November 2017 Restricted COS

I applied for one RCOS for my client and have not heard back yet. It's the first one I am applying for so I am a bit confused about everyone's comments on extra documents being submitted or asked for by the HO. Am I correct in thinking that the RCOS application is submitted through SMS and no docs n...
