I think common sense would prevail here, although I am not an expert I see 10 days short validity as within qualifying period as you are allowed to apply 28 days prior. Wait for experts.

Thank you everyone my wife has received her visa today. This might help clear the myst around less than 6 months visa validity. As I only have 5 months visa left. Thanks again and I shall come back with my queries about further extension to ILR.
