Are you sure, thirdwave? Was the clock not reset when he took the EU route? Hence he will get his PR in 2013.

The EEA2 form itself says only You may apply at any time during your lawful stay in the UK. If you apply when you are here unlawfully , that will be taken into consideration in deciding your application. and you are definitely not unlawful if your EEA FP has expired. I concur with Directive/2004/38/...

Just want to add. I phoned to HO and adviser said that it would look good if I as non-EU would send my wage slips as well as my EU spouse`s. Also he confirmed that non-EU members can apply for Residence Card at ANY TIME while on family permit visa but before it expires. (before I was told by immigr...

Sometimes, the more you explain without being asked, the deeper the hole you dig yourself into! Why not just say no, as advised by some members, and then supply the explanatory letter only if the need arises? They might accept your 'no' at face value, and if they don't, you can proceed to explain. T...

As I understand it, child benefit is not means tested. By this I mean, it doesn't depend on your earnings. So it's not given to you because you need it, it is a question of satisfying the requirements eg. immigration status. On a personal note, financially, we don't need it, but we were advised by t...

Thanks guys. I had to get back to the person in question to find out for how long he's been living in Scotland. Apparently, 10+ years, and all of them working as a doctor/consultant. So does this mean he can apply for UPV under UK rules, even though he's never applied for British citizenship (and do...

EU or UK ROUTE? WHICH IS BEST IN THIS CASE?

Can someone please assist? My husband's colleague is a German doctor/consultant residing in Scotland. He now wishes to bring over his African partner from Africa, but isn't quite sure how to go about it. They lived together in Africa when he was working there, and he often goes to see her, but he wo...

At one stage the UK was also known for refusing visit visas to people on the basis of not having applied for a visa before!!! You almost have to look twice when you read that. "We can't issue you a visa because you have never been issued a visa". Probably the most insane reason for a visa...

Re: Entry Clearance - With USA visa denial

Hi, I've just got my Workpermit :) In the VAF2 employment form Part 5 5.2 Have you ever been refused a visa for any country, including the UK? I've been denied a US visa before. The consult is not convice that I have a stronger financial ties. Should this affect my EC application chances? It should...

Re: Discretionary leave help

Hi, I need a bit of help as I haven't got a clue! My husband was granted 3 years of discretionary leave which will end in November 2009 (he did not qualify under normal rules as he had overstayed his previous visa). We had a lawyer to help us with the previous application, but as it is expensive, w...

I doubt that she can switch from EU route to UK route in-country. If she wants to get ILR in two years, rather than PR in five years, then I think she would have to go back to her home country and apply for a spouse visa under UK immigration rules. I'm sure others will come along and have their say...

Re: I got my EEA2 today!!!!

I also made the mistake of applying for the FLR(M) instead of the EEA2. This was rejected, but they still made me pay about £400 odd pounds. I will now appeal and try to get this back. It seems like a lot of country try this, Holland certainly asked us to pay about 800 Euro for a visa. They were u...

You're welcome! :) Yes, you have one year in which to marry, when you give in your notice to the Registrar with the COA. If you do not marry within a year, you will have to re-apply for a COA (complete with fees). When applying for a COA, you do not have to prove that you are single, if you've never...

In my experience, when applying for an EEA FP, the British High Commission tends to ask for documents as if your application was being considered under UK immigration rules. So even though the VAF5 (EEA FP) application form doesn't seem to require much documentation, you stand a better chance by pro...
