Yes it does mention 5 years.... Had this been the case, HO would just defer the implementation to Nov 11 instead of july 11, I think anyone reading the guidance notes for hsmp issued after the changes in Nov 06 would also have legitimate expectation for settlement. ...........................WAiting...

Hi ! I had a simillar experience at the PEO Croydon last week. very friendly and fast service.... Applied six months before expiry of current hsmp visa and recd the tier 1 valid for 3 years from end of current visa. As long as you dont claim additional points for age, you are okay to apply early. vc

That cant be true, what about post dated EC's. I got approval in March and got EC in Sep valid from dec 07 to Dec 09. Clearly, entry cannot be within 6 months of initial approval!

Have a look at page 24, FLR (HSMP) guidance notes, it does mention "Single 12 month period within the 15 months directly prior to your application".

Some interesting lines in the command paper (page 24) for Tier 1 - "Tier 1 is a route to settlement.......... we are considering the possibility of allowing the most successful to move directly to settlement after 2 years".

As far as I am aware, once you enter, you have to spend a minimum of 181 days in the Uk in a calender year to be a ord resident. There is no issue on travelling from the UK on business or vacations. Perhaps some of the seniors members could clarify this issue.

Jags, just to buy time to find a job, you could apply for EC in Aug (and request effective date from Oct 07). Thereafter you could enter anytime between Oct 07 to Oct 09. Although timeframe for ILR subsequently will be effected, but you will still make it for the renewal coz its the last 15 months t...

Dear Musafir, The guidance notes mention "Single 12 month period within the 15 months prior to your application". So any break, unfortunately would mean lesse points.
