Re: UK spouse visa refusal under 320(11)

What is the basis for your appeal? What new information have you got that you did not provide that will make them look at your case in a different light, or what did they miss when they reviewed your case in the first place and refused your visa? As far as I can see, if all you are doing is asking t...

Re: Visitors visa for friend (holiday romance)

You're here Brucem, and by the sounds of it doing very well, so you got a visa? Why should the UK govt allow anyone to turn up just because they want to come here (or in his case you seem to be dragging him here against his will?) Do you know how many people arrive to the UK and either overstay unti...

Re: Spouse visa from UK application

Hi, Are you married yet, or applying for your spouse visa now and awaiting the outcome? If so you should have paid the IHS surcharge, which I believe means you would not need to pay for the hospital fees. What is the status of your application? But from what I understand, if you have not paid IHS, I...

Travel Visa to Malta

Hi, Does anyone know if my Vietnamese wife, who is in the UK on a spouse visa, would require a visa to travel to Malta, since it is a British overseas territory? Can't seem to find the right information, so if you know where I can check. The .gov information just bangs on about Covid and travel from...

Re: SPOUSE VISA REFUSAL

Why does your lawyer think that the HO detaining and removing him because he entered the UK illegally was wrong? Something does not add up with this part of the story, since at the time of detention he would have been given an opportunity to put a case forward to stay. Obviously the HO considered hi...

Re: SPOUSE VISA REFUSAL

Nel, You stated your husband left the country voluntarily and yet the refusal says he was detained and then deported at UK expense, which was it? Also, they did not asses the other criteria, and I am guessing here, because he failed on 302 badly. No point, I expect. But do you meet all the other cri...

Re: Visa extension refusal - Home Office error!

I do not think there is anything stopping you from starting the pre-action protocol route right now, and run it in conjunction with your reconsideration. Make it plain in your letter that you are asking for a reconsideration, but in-order to speed things up if they fail to respond correctly, you nee...

Re: Visa extension refusal - Home Office error!

My advice is to go for a pre action protocol. Email them at their complaints address and explain that you are seriously considering taking legal action against them due to the ECO's lack of due diligence when considering your application to extend the spouse visa, and the lack of any sensible dialog...

Re: PRIVATE MEDICAL INSURANCE OVERSTAYOR

The insurance company will immediately suspect that because an overstayer cannot use the NHS, that this person is in need of medical treatment, and therefore likely to be buying the insurance so he / she can make a claim, rather than buying it hoping you won't need to use it. Plus, how can an overst...

If you think he is likely to still be married, you don't believe him, and therefore trust him enough to marry him.

Re: Words of Advice!

Where is domestic violence or controlling behaviour mentioned? Her husband just left and went to live with another woman.

The OP wants to know if there are any grounds she can stay, but since her marriage is ending so soon, her eligibility to remain in the UK, must have gone too?

Re: Overstayed in the past. Can I return now?

An outbound ticket does not mean you will use it. Having plenty of money is no indication you will return, none of what you have said is going to convince an immigration officer of your intentions to return. Not even having a job to go back to and a holiday form filled in. You overstayed for 2 years...

Re: Overstayed in the past. Can I return now?

So, is the only way you will find out if you are allowed into the country, is to turn up at immigration and see if you are allowed to stay? The reason I ask this is because I don't know if anyone on here can tell you for 100% sure that the immigration officer will or won't let you in. So, it would b...

Re: Overstayed in the past. Can I return now?

Caramelo, sorry to contradict you, but a hostile policy is designed to make it hard for people who are illegally here in the UK, that is the point, you were breaking our laws, it was not a case of anyone being nasty to you for no reason. Did you marry your wife while you were illegally in the UK, be...

Re: Talking to a girl for one year online, can't see her so can't apply due to covid

Just a note of caution, do you qualify for the fiancé visa, and spouse visa. I.e. sufficient financial resources, accommodation etc since your application will be looked at with a lot of scepticism by the HO. If you are planning to get the Marriage Visitor Visa, it will also be very tough as they wi...

Re: Repeated spouse visa refusals

No, you can apply for a visa again, but you must fill in the gaps, or fully answer the short-fallings you had with your original application. I guess if you fail a few times then you might well go on a list of auto refusal. How many times have you failed and why? Tell us why you are asking this ques...

It would be helpful to those who are considering a PAP, for you to share your refusal letter from the HO. What reasons did they give for refusing your visa and why do you say they are wrong?

Re: Marriage Visitor Visa Guidance

Hi, My wife and I got married in UK, with her on an MVV, so you can do it. It is fine. She will need to leave the country before 6 months ends, and then you apply for a spouse visa for her to come back and live with you in the UK. You must prove she will return to her home country, and that the rela...

Re: Marriage Visitor Visa Documents?

The HO are concerned that your Fiancé will not return to her home country after 6 months. She must prove that she will return and you both must prove that the relationship is genuine. The HO decided that despite pictures of my fiancé and I all over the World, her impeccable travel history, her profe...

Ali, I am sorry to say, but I do not think you will be granted one for you GF. I can say this from personal experience of how hard it was for me, and I was employed, earning good money, had met her loads, own home etc etc. The HO will almost certainly consider her a flight risk and deny your applica...

Re: Spouse visa appeal (article 8 human rights)

The issue is not the applicant's honesty, it is whether the he/she meets the requirements to qualify for a visa. If every applicant was able to argue extenuating circumstances, and be granted a visa outside, then that would make the guidelines irrelevant. And if only some people can overturn the cor...
