Re: Successful Appeal after Refused Spouse Visa- My experience

UA2015. Thanks, It depends on how you are self employed as to what you give them. I am not a company director, so provided them bank statements for a year, my tax returns for the last two years (get the IR to send them to you), a detailed description of how I make my money and evidence that it will ...

Re: Successful Appeal after Refused Spouse Visa- My experience

Halima, your case seems simple to me. They rejected you because presumably VFS failed in the their job (they twice omitted documents and mixed up the order of documents they scanned and sent for me, so no surprise) and secondly you did submit a ILETS qualification that demonstrated the required leve...

Re: Marriage Visitor visa vs. Fiancee visa?

Well, I can speak from personal experience here. My wife and I did exactly the same thing as you are considering with the MVV, although she is from Vietnam. We applied for the MVV since it was supposed to take only 3 weeks to get, but were refused (I won't go into the reasons, there is a thread, but...

Visa Start Dates

Hi All, My wife is off to VFS tomorrow to take her passport etc in, so she can have her spouse visa attached. Stupidly, the HO drags their feet for weeks on end before making the decision without giving a date when the decision will actually arrive, and then the recipient has to leave town within 30...

Re: Successful Appeal after Refused Spouse Visa- My experience

Thanks Amazonian, yes this has whole process of visas from her first two refusals for visitor visa, through being refused marriage visitor visa (which I had to threaten the HO with court to get them to actually look at the evidence provided) and now this, it's been a lot of stress and frustration an...

So Moses, your answer should come fairly soon. Fingers crossed, it sounds like a simple one, not unlike Juane, so probably will be granted.

Re: Successful Appeal after Refused Spouse Visa- My experience

Hi All, Yesterday afternoon my wife and I got great news as our visa application refusal was also overturned and we are now starting the process of getting her visa in her passport. We were refused a visa on the basis that I did not provide a set of unaudited accounts (I am self employed) as I did n...

Re: Spouse visa

Angel, My advice would be to get legal assistance. I know it costs £1,200+ but it will give you the best chance of getting the application passed first time. The last thing you want is to be rejected and then have to go through the fighting your case route, which is lengthy and costly (as you will p...

Re: ILR living in separate address

Seagul, you are wrong, it is NOT illegal to not be registered to vote, and it is NOT illegal to be registered to vote in one of two places, if you have two residencies. It is illegal to be registered to vote in two different places for obvious reasons. She is perfectly entitled to rent a property so...

Re: ILR living in separate address

You're assuming these things are joined up Seagul. The local council office will not be speaking to the HO and the HO will not find out that she rents somewhere else, it's impossible. Neither will the local doctors surgery be speaking to the HO, besides like I said she keeps those sorts of things at...

Re: ILR living in separate address

What do you mean Seagul? It will last for as long as they keep doing what I said. Besides, presumably they will see each other at weekends and holidays etc, so just because she rents somewhere else, does not mean they don't still live together, just not all the time.

Re: ILR living in separate address

The HO will not know where you both live, so just have all her documents, bank statements, pay slips, etc etc sent to one address, and keep the tenancy / mortgage and any other accommodation details in joint names, as well as council tax and utility bills. She can rent somewhere else without the HO ...

Re: Visit visa refused

Well, as it was pointed out before, and I have been told be an ex ECO now working in an immigration lawyers, lots of people just do not go back. My now wife was turned down, and she has a really good job, visa stamps from other European / Asian countries, so I can see why it is hard for your father....

Re: Visit visa refused

It seems to me that your only chance of success is to email their complaints about your case. I had to do the same to get a refusal overturned. My approach was to ask them exactly what I had to provide to get the visa, since the goal posts seem to be moving. When they say not enough evidence, ask wh...

Re: 28-day rule for fiancee visa

I suspect that if you had not provided the documents, you would have been given the right to appeal, and it would have been successful, so to avoid the needs for the HO to have to review the case again, freeing up time for them to deal with all the other appeals they get, they would consider slightl...

Re: Still waiting for a decision.....

Mine has been as helpful as he can be, and he even called me back and gave me some advice after reading my wife's spouse refusal letter. So I took his advice and he will write and support the appeal, and hopefully provide some influence for the H/O to look at our case quicker for work related reasons.

Re: Still waiting for a decision.....

Rexa, It won't hurt, but they can't do a great deal except write in support of your application, so I recently found out. Your MP might be able to get them to look into your case a bit quicker though, so in your situation I would certainly make the effort to call his office and let the PA know you w...

Re: Judicial review rejected now want to do a fresh application

Seagul, if the HO were to grant visas to anyone who overstayed, then it would not be right or fair to the rest of us who are doing things legally. It would send out the wrong message, come, overstay for long enough and get given a visa. I have no sympathy for someone who overstays, it is not rude no...

Re: Invalid reason on refusal letter

My advice is to email to the complaints. complaints@homeoffice.gov.uk and make it very clear that you are not looking for a judicial review, you are complaining that the ECO has not done his job correctly, and explain clearly why he has made serious errors. Explain that, you insist this reconsidered...

Re: Judicial review rejected now want to do a fresh application

So, for 6 out of the 8 years in the UK, how did you support yourself? Presumably you worked without paying tax or NI, since to pay tax you would have had to have had an NI number, and this is not obtainable unless you are permitted to work. So you cheated tax as well, unless you had a ton of savings...

Re: Tax year query- Self employed

I am no expert, but I would say it should be fine, since you do not have to file accounts 6th April to 5th April each year. But I would suggest that rather than write a note explaining it yourself, have your accountant provide one, obviously on letter head etc? Their explanation will be better recei...

I would expect that if your visa has expired and your appeal lost, then may they will detain you since they will deport you. What visa would you apply for?

Re: Slightly unusual situation

Why are you complicating things so much (aside from having two women sharing you, which will probably throw up its own challenges)? Simply say that the girl you are with now is just renting the place with you. She sleeps in one of the rooms and you sleep in the other. Do not say she is your girlfrie...
