Re: HELP! - ILR APPLICATION WITH MORE THAN 180 DAYS ABSENCE

Many thanks to all of you. Things happen for a reason and, probably, this is my time to leave and keep contributing in my home country. Probably they need me more. I will try to get as much support from Uni, but this is very low, and I think have met you in this forum has been very useful than talk...

Re: HELP! - ILR APPLICATION WITH MORE THAN 180 DAYS ABSENCE

Thank you. Which will be other alternatives for this case? under the fact I was with leave before April 2011? Should I cancel the ILR application? and apply for TIER 2 again? I don`t think anyone here can decide on behalf of you as this is very crucial decision. So far, it seems like your absences ...

Re: HELP! - ILR APPLICATION WITH MORE THAN 180 DAYS ABSENCE

Just in case, this link may help: http://www.ilpa.org.uk/data/resources/14771/12.05.28-Changes-in-Immigration-Rules-affecting-opportunities-to-settle.pdf -> Ergo, no mistake. Now, I think under the previous rules, I should be ok, and I need to explain that in formal letter?. Is there any example of...

Re: HELP! - ILR APPLICATION WITH MORE THAN 180 DAYS ABSENCE

Many thanks. I think it obeys since I got the visa before abril 2011. Nevertheless, I have made a calculation considering the rule before 11/01/2018. In this case, the absences will be in fixed periods counting forward the date of application, which is: 27/03/2013 -> 27/03/2014, 27/03/2014 -> 27/03...

Re: HELP! - ILR APPLICATION WITH MORE THAN 180 DAYS ABSENCE

It could be a mistake that you were granted Tier 2 General for 7 years. The rules strictly don't allow this. You should not have held a tier 2 visa past 14/03/2017, regardless of who your sponsor is. The 274 days absence will almost certainly be a problem. Hi CR001, can this be related that his ini...

Re: HELP! - ILR APPLICATION WITH MORE THAN 180 DAYS ABSENCE

Hi lookingforhope, many thanks for your kind reply. Indeed, I have entered to the UK as TIER 2 by 14/03/2011, then I got the extension for 2 years, then finally for 1 year more. So, my visa tier 2 expires on 28/03/2018. I presume is because the counting days is like that. Don't know. that's what th...

Re: HELP! - ILR APPLICATION WITH MORE THAN 180 DAYS ABSENCE

Hi jorgehh, I see you were granted Tier 2 in 2011. 3 year initial, 2 year extension and 1 year extension. This makes 6 year in total but it has been 7 years since 2011. Do i miss a point or can you confirm please? Start is 2011 or 2012? It is worth to check you have 6 year limit considering below cl...

Re: HSMP (JR) -> TIER 1 G -> ILR for DEPENDANT REQUIREMENT

Thanks CR001! I understand the recent rule change is for dependents only and applicable if there is a recent extension done after Jan 11 2018 and the absences prior to Dec 2017 will not be considered. Where as i am talking about the main applicant (Apologies i posted it under dependent thread) and ...

Re: 180 absence days

It is 180 days in any 12 month within your qualified 5 year period.

Only if your 190 day hits this criteria, it can be a problem.

For eg: You left UK on 10/02/2016 and was absent for 190 days until 10/02/2017, this may be a problem.

Re: Tier 2 - ILR - Absence issue with new rules

You also state 2020. Brexit should happen by March 2019, based on the Article 50 process. I was referring to latest news which confirms that May is about to accept transtion may be completed by Dec 2020. 2019 or 2022 is not changing my concern or status. Honestly, that was the least important detai...

Re: Tier 2 - ILR - Absence issue with new rules

we have an on-going job in UK for over 1 year which opens 10 –year route. (However, this visa type has a slim risk to be changed due to Brexit after 2020) Long residence ILR under the UK immigration rules has nothing to do with Brexit. It is EU citizens affected by Brexit who are on the EEA/EU rule...

Tier 2 - ILR - Absence issue with new rules

Hi everyone, First I would like to say that the forum is very helpful and I ensure you that I read nearly all topics under ILR. However, I would have couple of questions as our case is a bit complicated and unique. My wife came to UK in June 2013 under Tier 2 to work for a Global Company. I share he...
