When can I apply for EEA2 (Extended Family Member)?

Hello, It might be a stupid question but reading up about it, I have made myself confused. Extended family member arrives in the UK on EEA Family Permit. When can they apply for EEA Residence Card? is it the usual '28 days before expiry'? or can it be done earlier as well? I have seen conflicting ad...

Re: EEA FP Refusal Overturned by ECM

Hi Obie / CASA and other moderators, Do you guys know by any chance or any idea what does status 'BEING REVIEWED' mean? This is what the UKBA customer service guys told me when I called them up. I guess it means they are reviewing it which is pretty obvious but not sure what exactly are they reviewi...

Many, many thanks!
The refusal of the EEA Family Permit must be included in the new application when they ask if you have been refused a visa for any country including the UK in the last 10 years?
I appreciate all your help!

Re: SALA OVERTURNED BY COURT OF APPEAL NO LONGER GOOD LAW

Hi, My EEA EFM appeal was refused in January at FTT and the permission to appeal is also refused by FTT and now by UT as an excluded decision on 17 August 2018. How much time do I have to make a new fresh application? You can re-apply any time but I am wondering if in your appeal, you referred to t...

Re: EEA family permit refusal appeal or reapply?

I would advise against appeal because that can take months and months, they don't have timeline AT ALL for deciding appeals so you can be stuck forever. If I were you, I would apply again. Visa refusal sucks but its not the end of the world. There is a ton of information on this forum about evidence...

Sorry I meant the Lounes case. The EEA FP application of my dependent sibling was refused because of me naturalizing as British.

Re: EEA FP Refusal Overturned by ECM

Hi all, I am posting a note here just to ask once more if there is anyone who is/has been in a similar situation? or if anyone has an idea of what I could to chase UKBA for a decision. I have written numerous times to UKBA, contacted their (utterly useless) customer service which is not free either,...

Re: Detain/Bail letter received

So you don't have a problem. Unless there is something missing from your explanations? I believe it does apply to extended family members. I thought when you're granted 5 years based on EFM, you become a FM? An extended FM remains an extended FM, getting a RC doesn't change that. Extended family me...

The Sala Judgement is out and it is very positive. It is likely that OFM will have a right of Appeal as a consequence of this judgement. http://curia.europa.eu/juris/document/document.jsf?text=&docid=203963&pageIndex=0&doclang=en&mode=lst&dir=&occ=first&part=1&cid=61...

Re: EEA Family permit for MOTHER. help!

As far as I know, that is not correct.

I am only aware of the usual requirement that passport has to have 6 months before you can have a visa on it, not that it has to have any time left on it after departure from the UK.

Re: Do dual EU-UK citizens have rights under EU law?

As far as I can read, this all concerns EEA citizens who have permanent residence in the UK and have NOT become naturalized. That piece regarding implementation of Lounes is still 'pending' it says.

Maybe someone else can read some good news into it but I unfortunately don't. Not yet.

Re: Do dual EU-UK citizens have rights under EU law?

It looks like it depends on which case worker does your application go to - as usual. I have been chasing them for an update on my sister's case and this morning I have received the below response. We are currently considering our response to the Lounes judgment and envisage amending the Immigration...

Well there is nothing new really. The same nonsense they have been saying for months.

It has been 7 months since the decision and still their 'consideration' goes on.

In the meanwhile, our lives are on hold.

Visa refusal of my extended family member was overturned on 10 April 2018 (after I sent PAP as there is no appeal allowed). They said application is going to be reconsidered. Still waiting and no news. It has been more than 8 weeks.

Nope, nothing yet unfortunately so still waiting. I believe all the cases have been put on hold for the regulations to be updated, just hoping that happens soon.

Re: Do dual EU-UK citizens have rights under EU law?

I think it is very obvious that Home Office will have to abide by the Lounes judgement and treat dual citizens (who have exercised treaty rights in the UK and eventually naturalized) as EEA citizens for the purpose of their family members's visa/RC applications. The question of 'who will bell the ca...
