If your time abroad began before 11 April 2024 During the 10-year qualifying period, you do not have continuous residence if you were abroad for more than: 548 days in total 184 days in any 12-month period so what you mean is from government website, the 184 days in any 12-month period is not accura...

Re: ILR Depandent Visa or Citizenship?

In addition, I found this one from governement website: check if you can become a British Citizenship: https://www.gov.uk/british-citizenship If you’ve applied for citizenship, you’ll need permission to stay in the UK until you’re granted citizenship. Your permission needs to last until you have had...

Thank you for your answer. That's really helpful However, when I search online about switch from a visitor visa to other visa, it seems that you can not switch it in the UK. "No. Unfortunately, you cannot switch from a Visitor Visa to any other visa in the UK. The Visitor Visa is intentioned as...

Re: ILR Depandent Visa or Citizenship?

Thank you for your response. My wife is on a Graduate Route visa, which unfortunately does not allow for dependents to accompany her. Therefore, our options are limited to either obtaining a dependent visa for her to join me, or she can apply for a tourist visa. If my daughter were to come to the UK...

Biometric Appointment to Avoid a Gap

Hi There,

My visa will be expired in 10/02/2022 and I already submitted my new visa application. Do I need to make an appointment before the expiry date of my visa in order to avoid a gap for the 10 years ILR?

Should My Wife choose my Spouse Visa or Student Visa?

My wife is going to get her PhD degree soon. She could renew either a PSW visa or my SW spouse visa. The PSW will allow her to stay uk for another three years, which is longer and cheaper. But I will be formally working in UK for 5 years by 01/04/2023 without any gaps. My question is if she applies ...

Re: SW Application Pending on Further Document?

Sorry for the late reply, but I hope this is still helpful to some extent. My case was ended smoothly as I received my ATAS just in time (on the 14th day). I think the ATAS department is very punctual. But if one decide to submit after the expiry date, there gotta be some strong reasons to explain. ...

SW Application Pending on Further Document?

I'm about to extend my Tier 2 visa. My visa is going to expire after two weeks, but I'm still waiting for the ATAS decision (submitted one week ago). The employer cannot issue cos without the ATAS. I'm wondering can I submit an SW application pending on further document and then add that document la...

Inquiry about the ATAS Certificate

I submitted the ATAS application on 05/10/2021 but my current visa will expire on 26/10/2021. The official website states that it will take at least two weeks to get results for applications from researchers. So the timeline for my case is really tight. My new employer basically told me that I canno...

You need to apply for a new employer sponsored skilled worker visa before your current visa expires
So all I need to do is to submit the application before the visa expiry date, even if the job start date is later than it?

Inquiry about the ILR continuity?

My current job formally ends on 12/10/2021 and the visa expiry date is 26/10/2021. Now I got a new job offer but the start date hasn’t decided yet. I will discuss it with the new employer. So in order to keep my ilr continuity, the new job should start before 26/10/2021?

Re: Overstayed for 2 days back to 2014, will my case be rejected?

Was this history incorrect? • On 12/01/2018 you applied for further leave to remain as a Spouse which was granted from 16/02/2018 until 09/05/2021. Thanks for the sharp observation, it is correct. But on 01/04/2018, I switched back to Tier 2 until now. So I think the best route is still Tier 2.

Re: Overstayed for 2 days back to 2014, will my case be rejected?

Unfortunately, the previous 3 years continuous leave under Tier 2 route was broken when you switched to spouse route. Switching to Skilled worker route will reset your qualifying period again. You may be better off remaining on the Spouse SET(M) route. I didn't switch to a spouse visa, actually, I'...

Re: Overstayed for 2 days back to 2014, will my case be rejected?

If you answer truthfully, then it shouldn’t be the cause of rejection under the Skilled worker route. Else , they may refuse due to deception. However, if you succeeded in switching to the Skilled worker route, then your qualifying period for ILR in your current spouse route will be lost. I know bu...

Re: Overstayed for 2 days back to 2014, will my case be rejected?

Thank you for the prompt response. Yes, I'm also eligible for the spouse visa. Is it going to be more relaxed than the SW visa? The situation is that I just applied SET LR and was rejected due to this overstay. My previous Tier 2 applications were all successful prior to this rejection, where the ov...

Overstayed for 2 days back to 2014, will my case be rejected?

Dear Moderators and Members,

I overstayed for 2 days back to 01/09/2014, I didn't apply for a new visa within 28 days so the 3c rule doesn't apply. Now I'm eligible to apply for a Skilled Worker Visa. My question is will these two days' overstay history lead to a straight rejection?

Many Thanks

Dear Admin & Members My ILR application was refused one week ago, and I do not intend to appeal. My current visa expires on 14/01/2020, and the decision letter stated the following, "You have 14 calendar days from the date this letter was sent to appeal the decision to refuse your applicati...

Re: SET LR REFUSED WITH APPEAL RIGHTS

Correct, no stamp back to 2015. 01/09 is the date when I left the UK. When I arrived in my own country it was already 02/09 with an entry stamp. So there is no argument that I can make here.

Re: SET LR REFUSED WITH APPEAL RIGHTS

I thought the 28 days grace period should be applied to my case, but it is not. The approach that even one or two day’s gap in a ten year period is fatal to an application for indefinite leave does not appear proportionate. You left UK without valid leave on 2 occasions and reapplied well after the...
