Re: thanks puperpusher!

There is more to it than just needing a salary of £20k. Employers cannot sponsor people to be store managers of fast food chains. There are some catering roles allowed on the shortage occupation list but not if the post is in fast food. http://www.ukba.homeoffice.gov.uk/sitecontent/documents/working...

@ajmal The earliest I could visit my husband is in December, still about 3 months to go. I've purchased my airline ticket and have got a confirm flight status. Could you please suggest if it makes any sense to apply now with my airline ticket as an intention to visit to my husband in December? I'll...

Do it in writing to the CAT instead of in person. There doesn't seem to be a procedure to do it in person.

Marriage certificate etc. It doesn't matter if its difficult for them or that the UKBA have put the burden on them. That is what Article 25(1) demands. It is up to the government to set the system up in compliance with the directive. For example, documents could be checked at a police station on be...

The bit the employer lost was not giving her full pay (retrospectively) when she was suspended and was later able to prove her right to work during the period of suspension. Appeal against a decision that the claimant did not have the right to work in the UK during a period of suspension and so ther...

Do marriage certificates state people's nationality? I bet most don't? They also don't say if the non EEA national is joining or accompanying their spouse to the UK, nor if it is a sham marriage, nor if the EEA spouse is exercising treaty rights, nor if the EEA spouse has subsequently left the UK, n...

They can provide a full British birth certificate and evidence of their NI number.

Interestingly the UK opted out of an EU scheme where employers would have to notify their government of the details of their non national workers.

You are forgetting that it said that to score the points the applicant needs to have been awarded a UK recognised degree in appendix A too. I did two ACCA papers as a joke, took me twenty minutes and I passed. I accept it probably gets harder as you progress, but I found those two papers piece of pi...

ACCA is not a degree, not a bachelor's degree, nor a master's degree, nor a doctorate. It is at an equivalent level to a bachelor or master's degree.

It was paragraph 245FD(c) and (d) of the Immigration Rules that stated that the person needed to have been awarded a degree. Appendix A was also already in the rules. The guidance cannot be incorporated into the rules because the route has closed, but it doesn't matter because ACCA is not a degree. ...

The Immigration Rules said that people had to have been awarded a degree. I don't see how the Alvi case changes anything. In fact the Immigration Rules are quoted in the caseworker guidance. See pages eight and nine. http://www.ukba.homeoffice.gov.uk/sitecontent/documents/policyandlaw/modernised/cro...
