Re: EU Settlement Scheme & Toufik Lounes cases

Thank you for your comment. I really appreciate it. I contacted the HO and they said they cannot send it to me unless I provide all the information. I think they don't want to share the form. I find it strange because it's just an administrative form there shouldn't be nothing secret about it really...

Re: EU settlement - Non EU family member - CoA and decision time

Good evening, am happy to be here in this forum. A quick one, I want to make an enquiry for a friend who want to apply under EU settlement scheme. She is non eu but married to her husband with British Child ( her husband has limited leave to remain in the uk) the British child stays with them. Is s...

Re: EU settlement - Non EU family member - CoA and decision time

I am trying to find an EFM to Settlement case. I have been reading this thread for hours but it contains only married and partners of EEA.

If you know about any case of Extended Family Member applying for settlement scheme, please let me know

Re: STUDENT LOAN

If you are in the UK with a UK husband who never lived with you in the EU and who doesn't hold any other EU country citizenship (we don't count the UK one), then EU laws don't apply to you. As far as your immigration status is concerned, use only UK routes and laws.

Re: Lounes Case - Family relationship started before or after UK citizenship?

As far as I understand it, it doesn't matter. Look up the original Lounes case - in that very case, the relationship started long after British citizenship was acquired. Thank you for that. I checked some HO documents and you are right, they refer to the sponsor as a "Qualified UK national&quo...

Lounes Case - Family relationship started before or after UK citizenship?

Hello I have been trying to workout the Lounes in order to help someone. Is it important to consider when the relationship started comparatively to when the British citizenship was acquired? There are 2 options here: Option 1: The relationship started with the EEA national Later, the EEA national ac...

Re: Help/advice required, both panicking and scared

Also, any comment on the paragraphs in the refusal telling us to tell them why she should be allowed to stay, but not clear how? Anything you tell them, can be used against you later down the line if it's not well formulated considering existing law, previous cases and procedures in place. If you j...

Re: Help/advice required, both panicking and scared

I understand you want to write to the case worker and plead further with him about your case. However, even if it seems the right thing to do on a personal level, it's not productive to do it this way. The Home Office is a very formal institution and any move you do, has to be within a clear legal f...

Re: EEA Route (Family Member)

When I used to travel with my wife, I always took with me a copy of the Free Movement Directive (2004/38/EC). A few times I also sent an email to the Embassy of the destination country asking if my wife needed a visa. Then, I print their response and take it with me. The worst that happened to us wa...

Re: invite sister-in-law for holiday

Hello, It's not complicated. You need to send her: - An invitation letter explaining what you just said. You just introduce yourself (name, address, job, your company number, salary...) and then explain that you would like to invite your wife's sister (name, DOB, job, address) for holidays. - 6 mont...

Re: Help/advice required, both panicking and scared

The HO 'help' line is outsourced to any agency, with call centre staff who have very limited knowledge on the Immigration Rules, even on the simplest of issues and frequently give incorrect advice. I confirm that. Even the simplest queries are given answers very close to fantasy. For the OP. please...

Re: EEA Route (Family Member)

Please note that I am aware of the legislation, and I am aware about who should be legally allowed in the UK, as you correctly quote. I am not contesting that. It is trully sad to hear that people with the genuine right to enter the UK but without EEA documentation have not been allowed in planes b...

Re: Urgent help

You need to demonstrate your revenue but showing payslips and bank statements. If you started that job only yesterday, you are not going to have these documents in hands now.

You probably need 3 to 6 months before you are in position to demonstrate that you actually have this revenue.

I invited my mother, she is retired, holds a non-EEA citizenship and I said I will cover all the expenses. The visa was delivered within 10 days, no questions asked. No TB required for visitor visa. There was nothing special with her application really. Just she had to prove the usual things: her id...

Re: EU settlement - Non EU family member - CoA and decision time

Even if you are 1 day short, don't apply. Wait until you have completed 5 years to the day. Even 4.999 years is not enough. You need 5 years. Some here got lucky with settlement while they were a few weeks short, but it you don't have any reason to be in hurry, just prepare your documents and lodge ...

Re: Permanent residence card and new passport

Many countries won't let their citizen keep their old passport. They require it for any passport application and ty...

Re: EU Settlement Scheme Family Permit - Chances and advice request.

Hi lastchomikain Immigration law is static but each case is unique. What I can tell you from my own history (30 years immigration in many countries), is that you have to claim your own history and see how the rules would apply to you. It means, you are not looking how the rules work in general, but ...

Caution is not a criminal record and possibly there is no record about it anywhere. I recommend you forgot it ever happened. This kind of things are nothing but they can haunt you if you keep mentioning them. Being upfront about things like that can get you banned from some countries, refused entry,...

EU Settlement: Lounes paper form?

Hello If you apply for EU settlement as family member of an EEA national who applied and obtained a British citizenship, you will be required to fill a paper application. In this document, page 13, they refer to it as the "relevant paper application". https://assets.publishing.service.gov....

Re: HELP ... EU Settlement REFUSED ( Settled Status )

I did advised OP that it is sensible for him to apply under the EEA Regulations first. Not sure why he did not. EU16 is only relevant if the information is material to the outcome, not sure backed on what you have said, whether this was the case. If his EEA family member residence was no longer val...

Sorry, I am reading again your message.

What was your situation when you applied for settlement?

I understand that you had a EEA family member in the past but it's expired now. Was it expired when you applied for settlement?

Re: HELP ... EU Settlement REFUSED ( Settled Status )

Was she working? If yes, was she registered at the correct address with HMRC?

For EEA nationals, they check NIN records. But it's so easy to forget to update address with HMRC! If it's the case, their records won't be consistent with what you submitted.
