If he is a director of his own company that will be fine. write down that as his job title (it doesn't matter what his title is at his other job).
Thank you

Re: Long Residence and 2023 changes to Immigration Bail

Well it says: The following periods will break continuous residence: •Immigration bail, temporary admission, and temporary release •permission as a Visitor, Short-term Student (English language) or Seasonal Worker (or any of their predecessor routes) •overstaying which is not disregarded Of course ...

Professional Referee

Hi, This has probably been answered before somewhere but I needed confirmation on it still. I have a friend who I've known for years, he's also my colleague but he works part time as the rest of the time he looks after his own business which is a small pvt ltd company. His company and name can be fo...

Re: Long Residence and 2023 changes to Immigration Bail

This bit is still in, but the bit about bail not being "lawful residence" has been removed

The following periods will break continuous residence:
• immigration bail, temporary admission, and temporary release

Re: Long Residence and 2023 changes to Immigration Bail

You did not mention above that you applied in 2024 (??) but the new rule changes do not allow you to rely on historical 10 years anymore (so the discussion about the changes in 2023 is now not relevant ). The 10 years are calculated from the most beneficial date to the applicant and backwards: Appl...

Re: Long Residence and 2023 changes to Immigration Bail

In 2021 they refused my ILR saying that I didn't qualify as I spent those 4 months without a valid leave (they didn't consider the immigration bail) and granted me 2.5 year FLR FP with no right to appeal. So in my April 2024 application, I argued that I should've been granted the ILR back then as I ...

Re: Long Residence and 2023 changes to Immigration Bail

That is great news, however just so that this topic does not become a hot topic of discussion for other applicants, I believe you applied for your application in 2021 before the major rule changes introduced in 2023 and 2024. You are correct to note that the rules that apply to any application are ...

Re: Long Residence and 2023 changes to Immigration Bail

Hi, I received a decision today and I was granted ILR. The case I made was that Home Office made an error in 2021 in my decision, didn't give me any right to appeal despite it being a human rights application. And additionally, I mentioned that the rules regarding immigration bail is unclear since t...

Re: Long Residence and 2023 changes to Immigration Bail

As you can see above from the discussion we had in 2021, you may have break in your continuous residence Hi, so back in 2021 I actually did not have a break the case worker simply did not consider the start of my immigration bail into account while calculating the days (they calculated from the dat...

Re: ILR(Long Residence) eligibility concerning Exceptional Assurance

This is worse than what you even think. They expanded paragraph 39E to cover the Exceptional Assurance BUT then made ALL disregarded periods of overstaying under paragraph 39E as unlawful for the long residence. This is beneficial to people applying under other routes like the skilled worker route ...

Long Residence and 2023 changes to Immigration Bail

Hello, I have a question regarding the two changes to Long Residence route made in 2023. According to the changes that took place in April 2023 7.68 A person who has spent a period of time on immigration bail or as a visitor (or other temporary permission) who is later granted permission on another ...

Re: SET(LR) appeals?

So I decided to accept the 30 months LTR. After having spoken to a lawyer it seems I cannot accept Home Office's offer and still challenge it by initiating a PAP (based on the grounds that the length they are giving me is incorrect), as by accepting it there is no "refusal". Atleast that's...

This doesn't match your previous topic details? So which dates are the real/true story? https://www.immigrationboards.com/indefinite-leave-to-remain/set-lr-continuous-residency-period-of-overstay-t318815.html#p2023597 My apologies. For this post I kind of pulled the dates from memory. I'll start of...

SET(LR) appeals?

Hi, I received my decision today, the caseworker refused my ILR but I stead offered me 30 month LTR. The problem is, I can see that the caseworker had made some mistakes. First mistake: -I had a prior visa expire on 30th Jan 2016 -I left UK on 31st Jan 2016, so when I left I was an ovserstayer -I ma...

Re: Long Residence ILR TIMELINES - SET(LR) ONLY

Seems like everyone who applied around May has a roughly 4 month period of wait. However I submitted in July 20th and received a call today to clarify somethings. I did not expect them to get to my application in 2 months itself, but looks like I'll get a decision soon as from what I understand, onc...

Re: SET(LR) Continuous Residency period of overstay

I spoke to my solicitor today on this matter (who then spoke to a Barrister with 10 years of experience) and the gist of it is, nowhere does it say that a bail ends when you make a new application. And the small detail about the 2nd bail document being issued 6 days before the 2nd refusal date hinti...

Re: Help?

If it was 20 years then there would be been one option of the 20 year long residence route. Right now your options are slim as overstaying puts you in an unfavourable position. Perhaps more so if you came here as a tourist rather than a temporary residence visa. Yu'd probably be better suited taking...

Re: Set lr - Missing data consent form

Just for reference, to me, that same phone number suggested the following address: Nationality UKVI PO Box 306 Liverpool L2 0QN They also said that most likely the case team would anyway contact me with a link to upload the document- but I am going to pre-empt that if I can. Thanks For SET(LR)? Any...

Re: Set lr - Missing data consent form

Well that's the address they gave me when I called them asking about sending additional documents last week. You can call them on 03007906268 and ask yourself, though you'll have to wait a while for the call to be connected. The address you've got is a PO box, which is probably going to collect stuf...

I may be wrong about how far you can vary the application though. I don't know if it's possible to vary the application in appeal phase.

Re: 10 year long residence.

How/why was your case allowed and then refused and done so multiple times for the same case? You'd think they'd settle on a decision. It's a pretty strange situation. Your timelines don't reveal enough information but if you have been on section 3C all this time somehow despite it being part of the ...
