Well the work permit people are separate to the visa people. The work permit folks look at whether this application / skill set warrants a work permit and simultaneously or shortly after work permit approval a separate application must be made to the visa folks for leave to remain on the work permit...

In my case my ILR was refused and is now back with Home Office for reconsideration. Depending on the result further legal action will be pending. I just think some of these immigration officers are trigger happy. I understood that the new rules were to come into effect from April. And I would have thought that it would apply to people leaving after the new rules came into effect. But from the letter above even though the applicant was removed...

You mean if someone has overstayed here in the UK for less than six months and they wanted to apply for say ILR or otherwise the application should not fall for automatic refusal?

So they don't have to leave and re-enter.
