Well I'm confused. I thought that the 14 yr rule and the ten yr rule now featured under the same long residence criterion and that Home Office's standard time for deciding an application was 14 weeks. So why are we talking about years for a 14 yr application to be processed and are 10 yr rule applic...

SUBJECT ACCESSS REQUEST - A YEAR OVERDUE !!!!

Hi All, In August 2008 I made a subject access request and the data protection unit wrote back to me saying my request was being dealt with. Because I was having immigration problems I devoted my efforts to rectifying these problems. I did however notice that the data I requested was not forthcoming...

Behaviour to be citizenship factor

So will this change to ten years be applied retrospectively to people already on other scheme such as 5 year work permits.

What home office address for review / recon ??????????

What address do I write to to have an ILR refusal reconsidered / reviewed by the Home Office? I am seeing addresses in Croydon, Sheffield and Durham? Does anyone know the right one?

The initial application was in the long residence category from within the UK

Can anyone please help on this. What if anything says I have a right to an appeal if the notice is late?

I don't believe more detail is relevant in order to answer this question in particular but I will add that the application was refused because of disputed breaks in continuous residency throughout the ten years. It is a fact that right to appeal can be denied simply because leave exists at the time ...

The application was for ILR on ten yrs long residence. No appeal was given as I had leave remaining at the time/date of the refusal/notice but the notice actually arrived after the leave expired. I am clear as to how this came about but I want to know what says I can get an appeal because the refusa...

Yes it does say I cannot appeal and this is because it is dated prior to the expiration of the then valid visa. ie. I had leave when the decision was made but leave had lapsed by the time I got the refusal notice.

Late serving of refusal notice - right of appeal?

Hi all, If an applicant receives a refusal notice late as a result of an application for ILR I understand that the late serving of the notice means the applicant is entitled to an appeal. Is there anything you can point me to that specifically states this? I mean for example, if the refusal notice p...

subject access request - quick question

Hi All, I made a subject access request (SAR) in August 2008. Home Office acknowledged my request and said they were processing it. Now some six months later I have not received anything further from them. I am really cross with the Home Office and they have delayed many of my plans. I am now writin...

I think it would be a loss to the board to lose the insight of Frontier Mole. I personally have been helped tremendously and invaluably through the immigration process by his sagely advice. I think he is here to help anyone. This especially evident from the amount of his personal time and effort tha...

Jilly, I am sorry you are having such a hard time. I think though the position is that you are not facing a mandatory ban if you apply to return to the UK. The challenge is to find that way back. I think one of the unfortunate effects of immigration control is that it can end up bidding us against e...

If it is straightforward, I would not use a lawyer. The only person who *really* has an interest in getting your application right is you! There are posts on this forum from people whose solicitors have submitted apps late, lost documents, etc. I realise that would definitely be a small minority bu...

In my experience there is no advantage to having a lawyer. They are largely useless. You are better off researching the info yourself and using a forum like this. Apart from their charges they chat a lot of nonsense and are often less informed that say people on this forum. Also the ones I have deal...

Hkalian,

Do you think by letting the decision makers know how critical the job is to you that they may be able to work something out with you so you are not made redundant.

I mean you should try to influence the decision best you can.

I've had one back (Jamaica) and 2 pending. Will keep you informed, but there have been success stories here. Look around. SIX WEEKS TILL OVERSTAYER CONCESSION ENDS

DO NOT fall for this scheme until you have sought LEGAL ADVICE, and have heard of experinces from people returning under the scheme. Bush tried similar proposals in a sponsored immigration bill in capitol hill. The only difference was the undocumented migrant, having returned to his country of orig...

William, parallel to your attempt to "appeal" to the secretary of state, do you know if you were to make another ILR application (through solicitor so you don't get picked up), would you now be given a chance of appeal so that you can argue your case in front of the AIT? Failing that, is ...

Any other suggestions as to what I could do? Should I re-apply? Should I get solicitors to write back to HO to give me an appeal? If I re-apply now won't it be automatically refused since I am an overstayer? I have been told I can re-apply on the basis that I have had ten years continuous residence...

Please take this scenerio, a NVN who had been in the UK for say 8 years and went abroad and after five months came back (this person's visa expired after a month away from the UK) to the UK and obtained leave at port since he/she is a NVN. Would you say that, the 4 months away without leave is not ...

Yes I tried and got refused on the basis I did not come back with same leave - as mentioned above. There was a claim of late applications but I can deal with this. It's the date of posting that counts in one instance and in the other section 3c leave was in effect. The only issue is the so called ga...
