The overstayer concession 2008 and citizenship applications

Hello All, Back in 2008 an overstayer concession was introduced which stipulated that anyone who had overstayed and left the UK before a certain date (30th September I believe it was) would not have any future entry clearance applications affected by the period of overstaying. I availed myself of th...

I don't deny your point. I do want to hear what you think as I will be better able to gauge what I am up against. Regarding overstaying; when I got the refusal notice I was already an overstayer as the notice arrived after my visa had expired though it was dated before leave expired. I actually rece...

Guys I still need some more help.

Does the fact that they overturned the initial refusal show that it is their fault? Is there any case law that you could point me to that says the Home Office is duty bound to grant me citizenship if the overstaying was their fault or something to that effect ?

That's helpful. In your opinion does the fact that they overturned the initial refusal show that it wasn't the right decision and hence their error? I mean this regard to you saying unless they admit it was their error. They claimed I had two late applications - but they were not late; date of posti...

What I am asking is whether the period of overstaying causedby the refusal would hinder me from getting citizenship.

Breach of immigration rules and citizenship

In the naturalisation booklet AN - the requirements it states "You should not have been in breach of immigration law during the residential qualifying period. You should have been here legally. In other words, you must have had the necessary permission under the immigration laws to be in the UK...

Are the last five years legal ?

My application for ILR under the ten year rule which was refused in 2007 was subsequently granted in 2009 after a second review of my case by the Home Office. When my 2007 application was refused I became an overstayer and then left the UK and applied under the then existing overstayer concession to...

What happened to the proposals for earned citizenship ?

I read this on the home office website ? Naturalising as a British citizen in the future What are the proposed changes? On 20 February 2008 the Government published the Green Paper ‘The Path to Citizenship: Next Steps in Reforming the Immigration System‘. In this document we outlined our proposa...

Broken down marriage - what way forward

My friend had a student visa; then she got married to a holder of a British passport. I think she got married so she could get permanent residency here. Shortly after getting married she claims the husband was mean to her and atleast in one instance she reported him to the police. The relationship b...

Re: hi

Well no life is seldom ever that easy. One application - it is the date of posting that counts; recorded delivery...

The link posted above states that I should have 12 months without immigration control and the last five years must have been without a breach of immigration rules. I am presuming that because the period of overstaying fell under the overstayer concession and that I overstayed as a consequence of a r...

How do I get British citizenship/passport ?

I got my ILR based on ten years long residence in November this year (2009). It was granted after a second review of my initial application which was refused in 2007. When can I apply for British citizenship? And could I apply earlier owing to the fact that the initial application was in 2007 ? Plea...

Hi member, What I had in mind was this. The requirement for indefinite leave to remain under the long residence category states that the applicant has had ...[10 or 14 years depending on your category] continuous residency. So your application would have been based on the time you had already accrue...
