Yes, sadly in your case the first 3 years while awaiting for your status approval, aren’t counted as contributions stay. You would have to wait until you complete 5 years. Go ahead and apply, you have got nothing to lose but to gain. You may need to consult with an immigration solicitors. Also a proper covering letter explaining the good reasons behind why you didn't apply within the allowed time frame.

She should receive a new BRP for settled status I believe. You won't get a new one under the new rules. Her status can be verified online. Anyway all BRP's are expiring on Dec 2024 as well as the HO is moving to digital. Same happened with me when I moved from pre settled to settled. I had to apply...
