Zander, You could choose, if you wanted, to do it on the basis of German law, but I doubt this will be attractive. Well - unlike in the UK, the difference doesn't really matter. Spouse visas are free, and as long as your partner has a sufficient command of German, these visas are easy to get. In fa...

Thank you all for the great information, I had never though we could go to Ireland. The language barier was one of my biggest issues, now I dont need to worry about that. Uhm - do you really want to go to Ireland? From what I heard, they are worse than the Brits in some respects - better check out ...

Have a look in the forum here - there is plenty of information around. Keywords are: "Family Permit", "EEA2", "Directive 2004/38 EC" - and unfortunately also "Home office incompetence", "long wait" and "despair". It helps to read up on thin...

Hi 86ti, Hopefully the immigration at France wont be giving a hard time. Like another member here, I will ask the French immigration officer if I can travel to France on my Residence Permit and without my husband. Why alert them to a potential issue? As a Malaysian citizen, you don't need a visa fo...

OK - just found the answer myself, I guess: Recital 28 defines marriages of convenience for the purposes of the Directive as marriages contracted for the sole purpose of enjoying the right of free movement and residence under the Directive that someone would not have otherwise. A marriage cannot be ...

About the only way to turn down a Singh application under European law are that it is a fraudulent marriage . I have mentioned this before but didn't receive a definite response, as far as I remember: wet26 married one month before moving to the UK. Although this doesn't actually seem to be the cas...

In a way, I think the new process is good because at least they make sure that everything is there before adding an application to the queue. I think this has been discussed elsewhere already, but anyway: I see *absolutely* no advantage in the new process as the only thing they will do after checki...

Note also that you do not need to send your original passports. You can send photocopies. Note in your letter that you will send the original passports when they are ready to issue the Residence Card. Are you sure? From what I have read, they changed procedure on 1st June: http://www.ukba.homeoffic...

Re: South African dual passport holder traveling to France

If you have a valid British passport, I dont see even the slightest problem for you to move freely within the EU (and from outside the EU into the EU) - for the immigration officer (who you very likely won't even meet if you enter France from Britain) you are simply a British citizen. No need to sho...

Re: German citizen moving to Germany with non EEU spouse

Hi Zander, I have a German passport, but never lived in Germany. My partner has a Brazilian passport. We are married and currently live in the UK. She has a residence card stamped in her passport so she can live and work here legally. .... If we do decide to move to Germany I assume we will have to ...

And another possibly important part of the new guidelines is this: However, EU citizens who return to their home Member State after having resided in another Member State and in certain circumstances also those EU citizens who have exercised their rights to free movement in another Member State with...

There are interesting new guidelines (and they are only guidelines) about 2004/38 that were published today. The topic of "marriage of convenience" is quite prominent - but I don't know whether it will help you much. I haven't been able to locate the original, but the full text was recentl...

Re: UPDATE

He said that the immigration rules are interpreted differently by port officers and the government (???) I wish you could have recorded that one - would have been nice to have! I have no further factual input on this - but some thoughts nevertheless: Let's just *assume* (and I am not at all p...

Re: Passport for travel

One last advise chase UKBA and ask them to give you the name of the officer that they promised to appoint. This is the key to get your file processed !! I would think that the chances of finding out an actual name of a caseworker are pretty much nil. I now dimly remember talking to a caseworker onc...

That you are the family member of a UK national who has been exercising Treaty rights in an economic capacity in Spain and who is moving permanently to the UK. IO's are entitled to ask you to provide evidence of your entitlements. Easier if your husband enters with you. Or if he has to go to the UK...

I'm applying for an EEA FP because both my husband and I are living in Spain. He does not have a Spanish RC though. If I were in Australia (my country) then I would apply for a spouse visa. But as I am not, I am applying for a EEA FP. Yes - an EEA FP sounds right in these circumstances. http://www....
