Thanks Vinny.

Would you know how long do the children have to adjust their status before being considered illegal residents? I’m assuming once the father (main applicant) dies then his visa expires and consequently any dependents.

She’s been away since October 1st 2019, and it’s her mum who has terminal illness (cancer), we don’t have any plan at the moment for her return. She’s been away for 60 days already since 15th November 2018.

I’ve had my BC last week and yes I’m in the UK

Thanks CR001, usually it can take 30-40 days to get an appointment with UKVCAS after the application is submitted online, I’ve had this twice in the past 3-4 months, and she cannot return and stay that long, hence the question.

I was in a similar situation, emailed NationalitySupportTeamFMT@homeoffice.gsi.gov.uk and they said it can take up to 21 days to receive the letter, and it did arrive afterwards. You still have a lot of time but just email and check

Applied 10th May before the expiry but the appointment is not until 7th June, very difficult to get an early appointment if not in London

I think it’s because I read so many things here and elsewhere about refusals. Also HO are not always straightforward with their decisions, as sometimes they use part of the rules and not all of them to make excuses for refusals. could you just tell me what options would my wife have if the ILR is refused based on 319E?
1- can we appeal? and chances of success?
2- can we apply for PBS extension after refusal?
