Singh route and 'treaty rights'?

Is it essential that the UK citizen partner is working (earning money) while residing with non-EU spouse in another EU country? I thought that one was also exercising treaty rights by studying in another EU country, or simply living there as a self-sufficient person (eg by living on the rent from an...

Initial EU visa for Surrinder Singh route?

Suppose that the non-EU spouse of a British citizen, currently living outside Europe, needs to travel to an EU country such as France to join her spouse as the first stage of the Surrinder Singh route. The advice here seems to be that she should obtain a 'Schengen' (that is, a short-stay) visa and t...

Assuming your wife lives in Morocco, she should visit the Spanish embassy there. She will need to show your passport and wedding certificate. The embassy is then obliged to grant her a residence permit.

Thank you for the swift replies.

To answer the question posed, she arrived in the UK as a dependant of a student (her mother, my wife) and it was only later that I adopted her.

Dual nationality issue: ILR stamp for UK citizen?

My adopted daughter is Chinese, and would like to retain her Chinese nationality. Since I (British) adopted her before her eighteenth birthday, she is also a UK national and in fact holds a British passport as well as her Chinese passport. The problem is that China does not permit dual nationality, ...

Is a step-child regarded as a family member?

Would I be able to sponsor an application for ILR made by my wife's daughter, at a time when she (daughter) is aged 18. At present my wife could apply for FLR (M) and daughter (now 16) would be included in the application. (We have all lived in the UK since 206, but they hold visas as student and st...

She should immediately switch to FLR(M) ( 285 ) and subsequently apply for SET(M) ( 288 ). Thank you: this raises an additional problem. Our family includes her daughter from a previous marriage, aged 16, who is currently here on a visa as a dependant of a student. Her (our) daughter could be inclu...

Could you also answer my other question - under what category will she qualify for ILR? Since you mention she is currently on a student visa. I just want to be sure that she does indeed qualify. Thanks Sakura. I believe that she qualifies as the spouse of a UK citizen (me): we got married in the UK...

Thanks for the advice. Yes, I am a British citizen. I have read the linked page on requirements and it is clear that she will soon satisfy all of them, apart from the one quoted by Sakura, which I had not understood: You must be free from immigration time restrictions when you make your naturalisati...

Getting an ILR stamp when already a UK citizen

My wife will soon be eligible for UK citizenship (UK student visa at present). However, since her home country does not allow dual nationality and she wishes to keep her original citizenship, she will need to hold on to her old passport and ensure that it has a valid UK visa stamped in to it for any...

What does your visa say?

I would imagine that you have a residence permit for one country, and that does not give you the right to reside in another, only to visit.

Just to clarify: you do NOT need to be Christians to get married in an Anglican church. You should approach the priest (vicar, rector, whatever) in charge of the church nearest to your home. The basic condition is that neither of you should ever have been married before. The priest has wide discreti...

Yes, I can confirm that anyone who holds a visa for the UK that allows them to remain for more than six months can visit Switzerland without a visa. My wife (Chinese passport) travelled there with me earlier this year, and Immigration was quick and completely free from hassle. Have a great time there!

In my pre UKP days I went to Spain 7 times, and never once set foot in their UK embassy. Thanks Doc for the link, there seem to be ways around indeed, yet we're not sure how to exploit those as in September we'll be travelling to London to a trade fair likely carrying commercial goods so we don't want to antagonize the customs. Still thinking the issue over anyway, perhaps shipping goo...
