Hi Nuranda I would concur with Vicotoria that to apply for a settlement visa after only being together for 2 weeks would be denied, as the ECO would doubt the validity of the relationship. I think the timing of the marriage is not the key issue, but you need to show evidence of a relationship, and t...

Good afternoon. I've no new knews in my situation, but did want some opinions as to what my next course of action should be. As it stands I'm now 19 weeks pregnant, had a visitor visa declined in Kingston for my partner and have submitted a probably useless appeal under the Human Rights Act against ...

If the divorce is likely to be finalised by April then why not just go for the fiancee visa? This way she can come here and will be able to use the NHS. Otherwise, your idea of coming for three months then returning to get a new visit visa may well work. But if they think she will give birth while ...

Re: living?

so i just need to have residency in a closer country.. cheers steve That's right, but a visit visa or waivered visit visa doesn't give residency, so you can't apply unless you can get another type of visa that conveys residency, like student, work permit etc in that country... Ok. So a work permit ...

Unfortunately, you can only make the application from the consulate in the country you have residency...so, that means Australia. Victoria Hi Sorry to but in.... But is this the case? I didn't realise. It really has to be the country in which you're resident...... Bugger...... Why can't people go t...

Hi Frances, when you say you've read the Act, I imagine you are focusing on Article 8 (Right to respect for private and family life). There is, not surprisingly, a great deal of case law about whtat this means in immigration terms. The most recent House of Lords case is Huang v SSHD http://www.bail...

Appeal tribunals - as with most magistrates/judges/recorders in the legal system - get impressed by meticulously done research and careful preparation. It panders to their ego and makes them feel favourably disposed towards you. The overall impression of this man may be that if he entered into a &q...

Sorry! I'm trying to be clever and quote Sally! Sally. I've just had another look at the letters and they're very personal to myself and partner, so I don't think they'd be much use to you. From what I've heard from your story so far it sounds as if you've got a really good case. Am I right in that ...

Ok. The grounds I have for appeal are Human rights Act, and Race Relations Act. I do not have leave to appeal under the Immigration Act. So in essence this application was not considered a family visit - you were right Victoria.... Seen as there's no point reapplying for a visitor visa, we can't app...

OK! I've calmed down, well a bit..... I take your point that you can say just about anything in a letter and it could just be rubbish, there's no way of proving it... So how does anyone prove they'll return to their original country. Surely there must come a point where they have to take people at t...

What type of factual errors were made? Which paragraph of the Immigration Rules did they consider the application under? Yes thanks, I'd read that thread.

Hopefully at appeal things may be different, but I need to see the refusal letter with my own eyes first.

I'm just relieved it was considered as a family visit, even though we're not family - yet - so that I get the chance to go to court.

frances2 and sally12345, you do realise you can exchange solicitors' details via PM? My solicitor was in Manchester, she was very good, but NOT cheap, but I felt like I got value for money. I wouldn't post her details on the internet - I would like advice from mods regards passing on details of a solicitor. She did give me hope, but was very realistic that are chances are poor and v...
