Step Children

Can step father apply for non-eea children to settlement scheme as guardian/Parent or does it have to be mother (non eea as well but she will only qualify for pre settled ?). Step father is relevant person of Northern Ireland so if does application then children should be able to get settled status....

Tend to agree that if possible try and stay long enough to qualify for Irish passport and get it for both of you. Means can both live in any EU country which is a big plus. He does not have to - only you but may be easier. Process and info required as I understand it is considerably less and less stressful than UK fiance visa or UK spouse visa. Requirement is that partner was born in N Ireland. That is the key requirement. If not born in N Ireland will need to have been exercising treaty rights or had irish citizenship then naturalised as british. As of 24th August on that basis you can apply for eu settlement scheme. Don't normally like being proven wrong but in this case I'm delighted as did think they would apply the rules as now as opposed to what they are changing to. Home office applying common sense.

That was my understanding of pre-settled status. I think that route offers significant advantages over the current spouse visa route and dont think there us a loss of credit for time in UK. Ie shoukd be able to apply for settled status at the point of 5 years after arriving in UK which was a concern...

Based on your dates of August 2021 then only option will be spouse visa.

As I understand it you need to have started to live here by 31st December 2021 to use EEA permit and settlement scheme.
