Forgot to mention that if born in Northern Ireland and adopt children then will have option to register the Adoption with the Irish international adoption agency which will give the kids the right to Irish Passports which is backup if have problems with HMPO and British passports - I had that route ...

If you are going down the adoption route then need to think about where you will do. Doing adoption in UK will give them instant British citizenship once approved in UK court so end of the visa route for them at that point. OP didnt post all details of the mother's status but he did say that son was born before 2006 (1998). Rules changed in 2006 to cover citizenship from father when unmarried. As secret simon has said there is need to apply to the EU setlement scheme. When your child arrived in 2018 as a non-eu passport holder needed some form of approval to move which in this case was the EU family permit. Two options that I can think off to generate some form of response are: 1. Raise a complaint https://www.gov.uk/government/organisations/uk-visas-and-immigration/about/complaints-procedure 2. Wife applied on 9th June and got settled status letter on 24th July so about 7 weeks in her case. She is non-eu/eea. Our circumstances are bit more complicated than most so not sure if that may have taken longer to process.

Can only speak from experience of being a relevant person of Northern Ireland with two step children, both under 18. Both were also non-EU nationals. As spouse has renounced British citizenship then I believe you would have freedom to choose either. If not done then relevant person of Northern Ireland would have been only option. My personal experience with EU settlement scheme is if they need something they will ask for it rather than just reject the application. Seemed to do a quick check and if missing stuff (in my wife's case a number of documents did not load up)send email asking for missing info.

Back in August could use the BRP to apply using the app. After getting settled status and applying using the app and BRP my wife got a five year duration BRC as part of process. I'm a relevant person of Northern Ireland and as a result my wife qualified for EU settlement scheme. She was on the first of the settlement visas. She got a five year visa.
