Hi Garurav,

Tier-1 General category doesn't exist any more for new applicant. So you wont be able to apply for Tier-1 You will need to apply for Tier-2.

new point wont effect you since you will be extanding not applying for new Tier-1. so you are fine about point. but i am not sure about the CAP. if it will count the extension applicants or not. hopefully it wont otherwise there is a possibility of another battle in high court.

Just called Home Office and they said that the right procedure would be to leave the country and apply from the home country. Although, it wasmalso said that they can not stop anyone from sending applications from the UK, but if it is refused then it would mean that I'll overstay my 28 days period....
