Re: ILR Questions-Tier 1G (Emp+Self Emp)

Hi Abby, Please see here for clarification on your Q5. You can see where this is mentioned in the guidance by clicking the link near the bottom of my thread which is on the same question. I can't speak to the rest of your questions but hang in there. I am also SE + E and the extra work is a hassle! ...

Immigration lawyer recommendation - Tier 1 (G) SE + employed

Hi everyone, Sorry to ask this but I'm in a bit of a jam - I received two recommendations for good immigration lawyers from board members here, but they both fell through. I need to find a good London-based ILR lawyer within the next few days. My application is relatively straightforward, but as I'm...

Re: ILR (Tier 1 General) timelines - am I mistaken?

Thanks for the response, LoveStory. Can you link me to where it says this in the guidance or immigration law?

Also does anyone have any insight into calculating the 12/15 month window for Tier 1 (General) income?

Many thanks everyone, happy new year.

Hi Lovestory, Based on the guidance & other posts here, I had believed it was 28 days from the date of entry (e.g. 29/3), as that is indicative of the start of the qualifying period. If any gurus are able to respond to this and the other 2 queries in the initial post I would be incredibly gratef...

ILR (Tier 1 General) timelines - am I mistaken?

Hi everyone, I suspect I may be calculating my ILR eligibility dates/income windows incorrectly and would really appreciate some feedback. Questions in red for ease of reading. 1) Eligibility for ILR: My Tier 1 (General) visa was granted on 23/03/2009 I entered the UK on 29/03/2009 My visa expires o...

Many thanks Jambo. To clarify, my partner and I are not yet married - we are engaged , and will be married in the spring. I have years of paperwork that proves we've lived together for 3+ years. Does that change the strength of my connection to the UK / increase the risk of having 120 days outside t...

There is no same day decision for naturalisation as there is with ILR however, you can use NCS which will photocopy your passport so you can keep travelling. I don't see 120 days as a big issue if you meet the other residential requirements (i.e. less than 270 days in 3 years). You can explain on t...

Debating spending 90+ days out of UK for work in final year

Hi all, I know this is a long post but I wanted to include all relevant details. I would greatly appreciate any help any gurus are able to give. Immigration status/history: I am a Tier 1 (G) visa holder eligible for ILR in March 2014 on the basis of a continuous 5 year residence. I plan to make an a...

Thanks for letting us know, PontyGuy.

Could you kindly tell us the exact breakdown of days outside the UK you had at the point of application?

Also any tips on what you included in your cover letter would be much appreciated.

Many thanks, and congrats!

Thank you Lucapooka, that makes sense. I meant to write "bank statement" (not payslip). So I need to have earned AND received all payment within the 12 month window.

This is a common problem with self-employment income in the final months of the final year. The income has to fall within the 12 months as a credit into your bank account. This sum will not be considered if it is still an outstanding debt as there is no guarantee that it will ever be paid; it's not...

Self-employed Tier 1 G - invoice paid outside 12-mo window

Hi everyone, I haven't been able to find any info on this and would greatly appreciate any guru input. I will be applying for ILR in March 2014 on the basis of 5 years on Tier 1 (General). I will be using a combination of employed and self-employed earnings for the 12 period from Dec 2012 through No...

Note cs95tdg's (guru) response here:
you can use your income in lieu of notice as part of your previous earnings. So long as that amount is indicated clearly and independently from your redundancy pay (which cannot be used)

Thanks for your reply, Bildor. FYI I sent a Freedom of Information request about overseas earnings for Tier 1 (General) ILR applicants and posted their response here . Assuming the guidance Bildor posted (which is the most current version I believe) is correct, and that the UKBA agent who replied to...

The use of overseas earnings is permitted. Hi Bildor, Are you sure this is permissible for ILR applications? If you could point to anything in the immigration rules or guidance it would be very helpful. As cs95tdg says, there doesn't seem to be anything clear in the guidance regarding overseas earn...
