General Grounds for Refusal 322 (1c) "they have been convicted of an offence for which they have been sentenced to imprisonment for less than 12 months, unless a period of 7 years has passed since the end of the sentence"

It's not a conviction so you don't need to declare it and as such will not affect the outcome. Given the circumstances, it's likely there would be no way for the HO to ever know of the existence of this anyway.

In my opinion, as the husband left the family home immediately after being granted ILR, the statement that there was the intention to continue to live with the sponsor (your mother) was false. This would need proof that the intention to separate pre-dated the ILR application wouldn't it? Perhaps so...

Yes, that's correct but still, some provide the last 12 months payslips anyway. At the end of your application submission, you will get a list of all required documents which is normally last month's payslip and bank statement mainly.
