Yes that is what I meant. If the EU abusive partner was to maliciously try and get the Non-EU victim 'deported', would he be able to.

The case is one of domestic abuse. She left the house with the protection of the police, she is currently going through a rough time. If she does end up filing for a divorce. What happens in those circumstances? She arrived in the UK last year around March? Married for 2 and a half years

If a person has received PreSettled status for 5 years under the EU Settlement Scheme as a spouse, but separates from the spouse (not divorced, only separated) Does the person have to inform the home office?

The updated guidance (december 2020) states that 'family premium' of Income Support has been removed from maintenance calculations in the guidance. Hi

As far as I read the updated guidance on Adequate Maintenance, they dont include 'family premium' in Part C of the calculations anymore. But you can double check with someone more knowledgable in this field

No, he has been threatening her with divorce when he used to talk to her while he was here and wanted her to not meet/talk to certain people.
I just want to know if there is any way she can stay?

But..isnt her case one of domestic violence. As even though there has been no physical abuse, he has mentally been affecting her..threatening her with divorce, trying to control her as in where she goes and who she sees, not talking to her for such a long time etc.

Yes the in-laws are EU citizens, some with settled some with pre-settled status, but they won't be willing to help with paperwork if any problems e.g. divorce

Yes i calculated the child element, £54 I dont think you need family premium, please ask someone, as you are not sponsoring that child, that child has a british passport so youre not sponsoring her better ask someone, if that child doesnt count then you will need the savings i previously mentioned,...

I dont get CTC i get UC of £400ish pound which INCLUDES a child element of £235 a month.
