Re: Eu treaty enquiry

Yes you can still be denied after you are married. Especially if it looks like a marriage of convenience

Also, you won't get a temp stamp 4 based on an email, you'll have to get an appointment in Burgh Quay.

Re: EU treaty Expired Passport!!

Please do not listen to Obie. He does not understand how any of this works. He keeps insisting to posters that having a mariage cert with an EU national is enough for everything. One wonders why the various EUTR divisions are so busy then, given Obie thinks noone needs them!! There is one question h...

Re: EU treaty Expired Passport!!

Yes, 90 days is the initial right of residence. After that, you MUST REGISTER and apply for residency. This could not be simpler. If OP has been here longer than 90 days and has not got a temp permission stamp and a pending residency app, she's not legal. Metock isn't remotely relevant here, we are ...

Re: Moving to NI and be a cross border worker with "Stamp 4 EUfam"

Stamp 4 EU Fam won't be valid once she moves to the UK. In 5 years time she should have the "pre-settled status" but who knows what is going to happen to UK immigration in 5 years? Let alone what effect Brexit will have on border rules and cross border working, and whether the Surinder Sin...

Re: EU treaty Expired Passport!!

I'm afraid Obie is yet again wrong. OP has clearly been in State far longer than the 90 days and hasn't applied for residency, hence does not have legal residency in the State. You are only allowed 90 days to apply for residency and register, and after that you have no legal status, no matter that y...

around 18 to 24 months in court hearing. Try to check UK option as well. if it is possible for you, surinder singh route. Surinder Singh is only open to you if your "dependents" have LEGAL residence permission in the country you have been exercising FOM in. Doesn't apply here. Also someon...

Re: EU treaty Expired Passport!!

7 month old Irish child? So you have been how long in the State without legal permission? I'm guessing your spouse must be a UK national. You can't move forward with an EU fam application without a valid passport, end of story. You can't get a passport without legal residency, which you do not have ...

Re: Form 11 being returned, not considerble now any one knows what is the story

I don't have irish citizenship. Look like they are not consider form 11 application anymore, I am going to my solicitor, inis beyond their power now! They have no right to stop people applying citizens under certain law. This is shocking. I just submitted my children application through my solicito...

Re: Filipina Best way to join Irish boyfriend in Ireland

Its pretty simple: if you aren't married you need to fulfil the rules as defacto, which is 2 years cohabitation.

Actual spouses regularly get refused as they have only met a few times and/or have an internet only "relationship".

Re: Overstayer in UK but need to join my Dutch partner in Ireland.

A 3 month unmarried partner relationship to get a visa/residence for Ireland is most definitely going going to be heavily scrutinised. Heavily scrutinised? It's not going to happen. There are no categories OP can apply under. But without a passport OP can't even apply for any visa anyway, so none o...

You can apply as there are no changes during the Brexit transition period, but you won't get an EUTR visa for your brother.

Re: Are we eligible for defacto visa?

Yes, it most likely would. De facto means a relationship akin to marriage, you are asking to be considered to be the spouse albeit not legally married. if your sponsor is still married, they have a spouse already, and you are not it. Doesn't mean you can't get it, but you would need to show an awful...

Re: Stamp 4 EUFam visa doubt

And you need to also accept that the OP in this case was visa required, and was properly denied entry as he didn't have one. The ICO did not possess the necessary to do a full assessment of the OP's case, and had no discretion. The only option available was to refuse entry. I would have done the sam...

Re: Stamp 4 Eufam Revoked

That's unlikely to work. He's already been revoked, INIS won't reinstate just because his wife returns to the state, they would have to be currently in a genuine and subsisiting marriage, which they are not.

Re: Stamp 4 EUFam visa doubt

The law is the law. But there are very few lawyers working for INIS, and what actually happens on the ground day to day has very little to do with the law. A pinch of reality would be very useful to the people you are giving advice to, its no good to them you spouting on about what you think this la...

Re: Stamp 4 Revoked

Exactly. You were required to have a visa (in this case an EUTR visa) and you did not have one. Therefore you were not allowed to enter the country

It's not complicated in the slightest.

I'm not trolling, I'm just point out where your advice is wrong. Do you have a habit of banning anyone who disagrees with you?

You stated a visa could be procured at the airport. You and I both know that is not true. So why say it?

Re: INIS don’t response

They stop responding to you when you spam them with multiple emails when you've already been given the answer that you are in the queue.
It's such a waste of their time having to respond over and over again, they could be actualy working on applications instead.

You will NOT be able to secure a visa at the port of entry, Ireland has no facility to issue visas at the border.

Obie is unaware of what "visa" means.

I'd be less worried about your skills if you didn't make such worrying comments as "deport all, refuse entry to all"....

You don't even know the difference between deportation and removal and refusal of leave to land, it's highly concerning that anyone would engage your services....

Re: Stamp 4 Revoked

The ICO has the ultimate discretion, and allowed your cousin to enter, as s/he was able to do so. The ICO was not obliged to do so. Your cousin was very lucky. It doesn't mean it will apply to anyone else. OP here was unlucky, but the ICO was not wrong.

Re: Asylum or Stamp 4

1) you have no claim to asylum as you didn't claim it on arrival and you can't do so now 2) you need a specialist lawyer. You are illegally living in the State and breaking any number of laws and immigration rules. You can claim residency on grounds of your Irish born/Irish citizen child but it will...
