Re: SET LR advice

Will past breach ( may 2013)affect my march 2023 set m application. I don't think anybody will be able to foretell it because nearly all applications incorporate an indispensable question "have you ever breached the condition of your visa". Means you will have to keep replying spuriously ...

Re: SET LR advice

Hi guys,
After long consideration i am more inclined to go for flr fp (parent ) extension rather than set lr.
Will past breach ( may 2013)affect my march 2023 set m application.
Am i going for a safer option?
Please advise me. Thank you.

Re: SET LR advice

Have you ever requested your employment history from HMRC or checked by yourself by registering online? Does your tax visible during 2013? No, but i have looked online , it doesn't let me see more than 5 year old tax record. However, i can see ni contribution and it says "contribution from pai...

Re: SET LR advice

Hi, i just realised after a breach in 2013 when i extended my tier 4 in late 2013 , there was a question if i have worked contrary to the brp. And my answer was no, if they discover that breach in 2020 set lr application, will it class as deception or just a 322(3)? Thanks Possible yes as you have ...

Re: SET LR advice

Section 3c ends when an application is refused. The 14 days is only a grace period to apply for another route you believe you qualify for, it does not extend your 3c protection. Thank you CR001, 1. so vary won't be possible in the event of 30 months offer , to flr fp 5 year parent route? 2.if vary ...

Re: SET LR advice

Can i still be able to not pay that ihs but instead apply for new application flr fp parent under 5 years. My visa would have been expired by few months by then , will 3c cover me and my application will be valid. Depending on the caseworker if you wont accept his offer then he might withdraw it an...

Re: SET LR advice

Hi guys i am still unsure what exactly i should be doing in the event of refusal please advise me so i can start planning. My visa is expiring in 20 September 2020 (parent under 5 years), and iam going for set lr, if it gets refused on 322 ground that happened in 2013. Depending on if there will be ...

Re: SET LR advice

Based on this information, it says they are treating the application under limited leave and will only be valid once the ihs is paid. Doesn't this means its not decided and still possible to vary? Highly unlikely that caseworker swerve his offer in accordance to your desire. I agree but the standar...

Re: SET LR advice

If such situation arises to me , will i be able to vary to flr fp 5 year parent route ( i meet all the requirements) . currently i am under 5 years parent route. Varying might not be possible where if the caseworker is offering you an flrfp under 10 years of route rather at later you might be able ...

Re: SET LR advice

Hi, I came across a case on this forum that op had applied for set lr but was refused on 322 ground, however, he was offered 30 months leave under flr fp if he were to pay ihs within 10 days. If such situation arises to me , will i be able to vary to flr fp 5 year parent route ( i meet all the requi...

Re: SET LR due

This should not affect any visa application except for ILR Thanks zimba, just seen it. It was old so i forgot. I should have applied for set lr in January 2020 super priority and if it were to be refused i would still have valid leave to extend my flr fp parent( 5 years) . Can't believe i missed th...

Re: Set LR and previous breach

If the breach happened in 2011, then ILR will be refused under SET(LR) as in the last 10 years there should be no breach. It does not matter when UKVI noticed the breach Thank you zimba for this clarification. Then am i right to say that if my set lr gets refused in 2020 because of breach in early ...

Re: Set LR and previous breach

Try in 2021 Hi zimba, Op breached the condition of stay in 2011, but that came to the attention of ukvi only in 2013, doesn't that mean he can only apply set lr successfully in 2023 ( after 10 year lapse from when ukvi foundhis breach). 10 years after breach was found by ukvi rather than the past d...

Re: SET LR advice

Hi all , Just got a thought that if my set lr to refused coz of breach in 2012 , and if iam to given 2.5 year visa under flr fp. Will i still be able to apply for set lr in 2023. Or i have to wait till 2030 ( 10 years from when breach came to attention of ukvi rather than when breach happened, i saw...

Re: Set LR and previous breach

I took the risk. I have applied for set LR. There is a delay due to the covid 19 Best of luck. Even if they refuse set lr, i think they will consider under 10 years route and ask you to pay ihs but you can vary to 5 year spouse soon after paying ihs, so they don't decide it and vary is still applic...

From your post... I can see the breach happened in 2009? That is more than 10 years ago.🤔
It was 2012

Re: Set LR and previous breach

Yes correct. After presentation of payslips and bank statements! Ok. Do you know anything about ' Zayn121 ' breach. Was it discovered through payslip and banks statement that he presented when he applied for spouse visa? I would have asked him but his page is locked. I saw update from him and his i...

Re: Set LR and previous breach

Breach 322 (breaking a condition attached to leave).in my case, it was working more than 20hrs as a student. My income made them question me at the time. Lucia So they checked internally and discovered it by themselves or you presented your income on bank statement to them to meet income requiremen...

Re: Set LR and previous breach

I entered the UK in April 2010 on a student visa, which expired in July 2013. I however applied to vary leave to spouse visa in March 2013. This was refused on paragraph 322, no right of appeal as I still had leave left but visa wasn't curtailed. I reapplied on FLR fp before visa was expired, retur...

Re: SET LR advice

If you lodge an appeal, you cannot make a new application until you withdraw your appeal, and your section 3C ends at that point. The risk of set LR being refused in your case is highly likely as you breached your student visa conditions. Ok. What if i don't lodge an appeal instead i apply flr fp 5...
