Re: Continuous qualifying period for settlement scheme

Has the law changed? Because it definitely used to be that you could get Settled Status after 5 years of marriage while in the UK.

Re: Non-EU citizens travelling at the border with Presettled Status

Were the border agents familiar with presettled status? What questions did they ask you? Are you asking about the experience of having only electronic Pre-Settled status and no card (e.g. only EEA RC)? Or are you asking about the experience of having a EUSS Pre-Settled Status card? I think there is...

Non-EU citizens travelling at the border with Presettled Status

Hello

I’ve been wanting to know what the experience of travelling back into the UK for non-EU family members with presettled status is. Were the border agents familiar with presettled status? What questions did they ask you?

Re: Do I have to pay for the Healthcare Surcharge if I apply for an Ancestry Visa and work for the NHS?

Pity the healthcare surcharge is so damn expensive considering I work for the NHS and that you have to go back to your home country to apply for it. It's £12 a month (£624pa /12) £1.71 a day and covers existing conditions, but has to be paid up front for the visa length. Much cheaper than some othe...

Re: Do I have to pay for the Healthcare Surcharge if I apply for an Ancestry Visa and work for the NHS?

Yeah I tried it and it says my biometric residence card is no longer valid. Guess I’ll wait it out until December next year to apply for Settled Status. If the laws change around the EU Settlement I’m sure the Ancestry Visa will still be around in case I need it as a back up. Pity the healthcare sur...

Re: If someone with presettled status is unemployed are they considered illegally resident in the UK?

I just wish there was clearer legislation on this instead of this uncertainty. Lots of EU citizens with presettled status lost their job because of covid.

If someone with presettled status is unemployed are they considered illegally resident in the UK?

The legal basis of presettled status is the Withdrawal Agreement. The Withdrawal Agreement seems to indicate that the rights of those who are employed and those who are unemployed with comprehensive sickness insurance are protected. Does that mean that someone who has presettled status and is unempl...

Re: Do I have to pay for the Healthcare Surcharge if I apply for an Ancestry Visa and work for the NHS?

My husband phoned the Home Office and they said my Ancestry Visa was cancelled when I received presettled status.

Still not entirely sure if my Ancestry Visa is valid or not.

Re: Do I have to pay for the Healthcare Surcharge if I apply for an Ancestry Visa and work for the NHS?

So is my Ancestry Visa still valid despite the fact that I have presettled status? I thought you couldn’t hold more than two visas at the same time under UK immigration law.

Re: Do I have to pay for the Healthcare Surcharge if I apply for an Ancestry Visa and work for the NHS?

My understanding is that when I switched to presettled status my Ancestry Visa was cancelled as you can’t have more than one visa issued under UK immigration law. Exercising treaty rights is not currently a requirement for getting settled status but it could be a requirement in the future. The gover...

Do I have to pay for the Healthcare Surcharge if I apply for an Ancestry Visa and work for the NHS?

Hello I currently live in the UK on presettled status as my husband is an EU National with settled status. I am thinking of going back to my home country to switch to the Ancestry as the UK government has drafted a law that says that applicants to the EU Settlement Scheme from next year will have to...

Re: Citizenship and pre-settled status

Wait, so am I correct in understanding that I can apply for Indefinite Leave to Remain based on my Ancestry Visa even if I have switched to presettled status? My Ancestry Visa is valid until 2022, I switched to presettled status last year. I think ILR based on an Ancestry Visa is preferable to settl...

But some people are being granted status in a few days even with the Covid crisis.

Should I make a formal complaint if my application hasn’t been decided within a month?

I am a non-EU citizen who applied for Settled Status at the end of June. I have not received a decision on my application. The website says applications shouldn’t take longer than a month. From what I understand applications take longer than a month if the applicant has a criminal record or if they’...

Re: Settled status before 5 years of marriage

I’m not clear on whether it’s 5 years of marriage or 5 years of residence for non EU spouses. On the website it says 5 years of residence but other people are saying 5 years of marriage.

Settled status before 5 years of marriage

Hello I was wondering what the chances are of non EU spouses who have lived in the UK for 5 years or more but have not been married for 5 years being granted Settled Status? I have seen numerous posts where people who have lived here for 5 years but who been married for under 5 years being granted S...
