kathrynvt you should look at 8 CFR 214.2(p). You can find this regulation at uscis.gov on the link "Laws and Regulations". Then click the link to 8 CFR on that page. You can then track down 8 CFR 214.2(p) and its requirements.

I don't have the answer at hand at the moment as to when F-1 status terminates. I can say that USCIS or an immigration judge have to make a finding that you have violated F-1 status before you begin to accrue unlawful presence, which has serious consequences if you leave the U.S. and try to return. ...

We had no plans to move back to the US at that point (hindsight is proving to be 20/20!). I'm handling a case like this at the moment. (Although my client never left the U.S. for over a year, he still is facing some of the same issues you would face upon returning to the U.S.) If you did not intend...

As a general rule, if a person's home country will not accept their return, the U.S. won't be able to deport them.

Re: US Visa for an Overstayer in UK

If your Passport has been marked with an overstay write up in the UK, will it effect a visa for US. Even though UK has given the VISA That's a good question. There certainly isn't any such provision in U.S. immigration statutes. There may be something hidden in the more detailed regulations but I'v...
