Healthcare is not public funds - It is a fundamental right. So you do have access to NHS.

I got work permit approval near the end of my phd course. I completed my 3-year phd course but I have not submitted my thesis when I started on my work permit. This was more than 5 years ago, I do not know if the law has changed.

There should be a homeoffice reference number on the visa stamp? is it different to the recent visa(s)?
The reference numbers on the 2 visas are different.

The reference number on the second visa (granted in 1999) also appears in all my subsequent leave to remain stamps after 1999.

The only way out would be a amendment in the rules to close the loop hole... maybe this might change when it becomes Tier 1....

Tier-1 will accept Bachelor, Masters and PhD.

I am full-time student in UK from Sept'05 to till date. Hence, my previous claiming period between Aug'04-July'05 ie. 12months out of 15months before I became student.
