Re: Applying discretion in absence: met or didn't meet requirements?

hi, I'm preparing my application in advance on the website, completing all the bits I can complete by now. not at any point was I asked if I want to apply on the 3 year route as a spouse of a British citizen, or on the 5 year route (on my own). and I was asked for my marriage certificate and spouse'...

Re: Applying discretion in absence: met or didn't meet requirements?

you can apply under 6(1). thank you. how do I go about proving I've established UK as home if we'd sold the house and divorced by then? Finances is easy, I can supply all my P60s and salary slips I suppose, a bank statement too maybe? employment is also easy, a letter from HR. but the home and fami...

Re: Adult dependent relative visa

hi, I'm sorry to be the bearer of more pessimistic view on this. I have applied for my late mother for ADR in September 2022. she had chronic schizophrenia, a very severe case, well documented by 20 years worth of doctors appointments and continuous assessment. I'll tell you now what I had to provid...

Re: Applying discretion in absence: met or didn't meet requirements?

one more question please, thought it was obvious but now not sure anymore. I had obtained my ILR as a spouse of a Biritsh citizen, am I okay to apply under 6.1 though? I'd rather the 5 year route because of all the absents. also because we might divorce by then anyway. but if we were still married, ...

Re: Applying discretion in absence: met or didn't meet requirements?

is there a list of suggested evidence to provide for all of these? do I need to get letters from friends and colleagues for example as way of showing that I have made the UK my home? the group of friends with whom I play football for example? these kind of things? thanks

Re: Applying discretion in absence: met or didn't meet requirements?

Can't imagine that would play a role, if you are applying in your own right. Be also sure that you were in the UK the day five years before you plan to apply (eg if applying on the 8 Aug 2024 you'd need to physically have been in the UK on the 9 Aug 2019). hi, one more question please, when they sa...

Re: Applying discretion in absence: met or didn't meet requirements?

It does specify that if you intend to ask for discretion on one requirement you need to meet all other requirements, including the absences ones. They set the statutory requirements, and absences are definitely a factor they keep into account to determine if someone meets their bar. Strongly advise...

Re: Applying discretion in absence: met or didn't meet requirements?

If you want discretion on one requirement you need to meet all other criteria, no "double whammy" allowed. If you wait until your absences in the last year have gone under 90 days you will be able to apply then. thank you. I was afraid of that "last but not least".. I had ...

Applying discretion in absence: met or didn't meet requirements?

Congratulations and hoping the visa get put to use. The feedback is appreciated; factual and no sugar coating. And a glimmer of hope for people who will go the route.

Re: Urgent Help - Mother in UK - Widowed

I think consult a lawyer ASAP. If you need to apply for an ADR, there is a lot of work ahead to prove that she is "dependant on you". The good news is, she's already there with you and she'll probably be able to stay while it's being looked at. Unlike me, where I had to leave the UK for th...

ADR refusal overturned before tribunal

Hi everyone, I applied for my mum (who suffers from schizophrenia) for an ADR visa back in September 2022. I have posted questions about this back in February 2022 before finally submitting end of August 2022. Application was rejected in December 2022 (short processing time given a child's interest;...

There is no specific requirement for these under the rules. Provide 3 pieces of evidence from at least 2 sources anywhere in the the last two years
Thank you. did you mean 6 pieces of evidence? the quote I attached was directly from the application.
please advise.

Re: ADR application [Schizophrenia] question(s)

P.P.S: even though I read somewhere on the gov's website that I can apply for this visa for my mother before I'm settled, the lawyer made it clear I had to wait till I have my IRL to apply. I must've misunderstood what I initially read on there. The website is very clear on the requirements. Apply ...

Re: ADR application [Schizophrenia] question(s)

after a lot of research, I did find a law firm that seem to have enough experience in ADR visas and dealt with different cases of adult dependent relative visas with mental illness. I found a couple actually but one of them they dealt with a lot, especially the famous Osman v ECO [OA/18244/2012] cas...
