Re: Set M-ILR - Appendix FM 5-year partner route (Super Priority Sevice)

Could this be because you applied before completing 5 years on the 5 year route? This is what the SET(M) form says: Use this form to apply to settle in the UK as a current spouse or partner of a person present and settled in the UK or as a parent of a child present and settled in the UK and you have...

Re: SET(M) - legal ground for 28 days before completing 60 months?

I already covered this above and even showed how the guide refers to this indirectly. You are free to adopt any interpretation you like. You seem to like being a contrarian and arguing, even when you are not correct. I had to correct you before: https://www.immigrationboards.com/viewtopic.php?t=346...

Re: SET(M) - legal ground for 28 days before completing 60 months?

This has been repeated hundreds of times over the years that the 28-day concession is just a concession . It is NOT part of the immigration rules and does NOT show up in the immigration rules but you still come here and talk about this magical rule. However, there is no such rule I am afraid. So do...

Re: SET(M) - legal ground for 28 days before completing 60 months?

There is no law or 28-day rule, this is simply a concession by the home office that allows immigrants to make a further application for leave a bit earlier than required. Some might face difficulty extending their leave or settling without this concession. For example, the rules require you to comp...

Re: Help required, SET (M) ILR mental health question

Thank you for your help guys! It would have been not possible without your guidance. I applied on feb 10 had biometric on 29th Feb , super priority and received approval email. Thank you Zimba and team! :) :) Hi and congratulations for your ILR. I have a question, please: Did you tick yes in the me...

Life in the UK test pass question

Hi all I passed my life in the UK test last month and I changed my address this month so the postcode is different from the email containing the pass notification. The current postcode mentioned in the email was correct at the time last month. 1. Will this be a problem when applying for SET(M)? 2. I...

Re: Help required, SET (M) ILR mental health question

You stated the question is regarding requesting an exemption for the English language and Life in the UK requirement. If that is the case, how do you explain the questions under other relevant sections that directly and specifically ask if you're asking for an exemption? Can you then conclude that ...

Re: Help required, SET (M) ILR mental health question

The visa application is not a full disclosure. :!: That question is asked for people who need to apply for an exemption from LIUK and the English language test. Only answer yes when you are trying to get an exemption which requires evidence from a doctor I am going through the same situation and ki...

Re: Set(M) Question

Actually under family route rules, the ' insurmountable obstacle' is defined under Paragraph EX.1 which does NOT limit an obstacle to qualifying just to the requirements under appendix KoLL. In fact, it is quite extensive. I repeat again that the questions on the form are NOT intended as 'full disc...

Re: SET(M) when to apply

You seem to be reading the guides without understanding the context and making up your own interpretation of the procedures. I still do not understand why you are insisting on having section 3C :? Section 3C has NOTHING to do with your appeal rights and you do not lose any appeal right because of i...

Re: SET(M) when to apply

I do apologise if I'm incorrect in my previous questions. I'm just anxious as to whether I should apply before expiry date and book a biometrics appointment before the expiry date, or whether I should wait for the biometrics appointment to be after the expiry date to secure section 3C? Is it support...

Re: SET(M) when to apply

You are correct that if you have no Section 3C to begin with, then a subsequent appeal will not give you Section 3C protection if your visa expires. However, you do not lose your right of appeal later. I am not sure how you arrived at that conclusion. The right of appeal does not depend on whether ...

Re: SET(M) when to apply

Again, who told you that Section 3C and your right to appeal are somehow related ???? I am not suggesting that they are related whatsoever, however, I am aware of the fact that the right of an in country appeal can be given even if you are NOT on section 3C which as far as I'm aware is not a good i...

Re: SET(M) when to apply

1. You apply when eligible for ILR. There is no advantage in delaying your application. 2. If your application is refused before visa expiry, then you must apply again before expiry in order to benefit from section 3C protection. 3. I am not sure what you are talking about here. Section 3C has noth...

SET(M) when to apply

Hi all I have a couple questions (including hypothetical ones just to understand the process). I am on the 5 year route and I will be eligible for ILR in August 2024, and my visa expires in October 2024. 1. What are the advantages and disadvantages of applying early in August 2024 using super priori...

Re: SET(M) Place of birth question

You're overthinking this! As an example, my passport mentions neither the country nor the town where I was born but the state (where several towns are located). During my ILR application I came across these questions and I responded what they're asking. Country of birth: country Place of birth: tow...

No recourse to public funds question

We found a freehold property that is discounted through the Discounted Open Market Housing Scheme (Section 106), this is where the property has a reduced cost and you must meet the eligibility require...

You are overthinking this for no reason. This is the advice given to hundreds of others. I am just really confused as thi...

Re: Set(M) Question

It is also not just asking me if I have a condition but asking about my partner as well if she has a physical or mental condition and so this is not relevant for an exemption for KoLL as my partner is settled and is British? Makes me so confused as KoLL has its own question for exemption which we ti...

Re: Set(M) Question

FLR(M) is a different form. Just answer NO as you are NOT requesting an exemption. The evidence is obviously only required if you ARE in fact seeking any medical exemption. If you are not making any medical exemption of any sort, then such evidence is NOT required. As I said do not treat the questi...
