All I can say is that if he was out of time for four months, then he has to have a good explanation. And you say, he didnt offer one to the home office. I find that hard to believe. Hi, That I will find out when i get his file, what I want to know is if he did not offer an explanation to the HO for...

OK thanks. Problem is, as this is a new restriction (since the introduction of Tier 1) there is nothing about 'past experiences' (at least as far as I could see). Thanks for your help all the same Thats true but I remember people talking about it so you will have to search it on the forum and or us...

Hi, We have requested his file and will know more when I get it. But my point is if there are no reasons and he was just blatantly late and was still given ILR. First of all, I KNOW that there is no incountry switiching from WHV to Tier 1 If you review my former comments, I quoted this info to someone else which seems to me you have now copied to make it look that it has been done by your own research. oh really !! Yes Really. See http://www.immigrationboa...

Hi, I just found my covering letter which stated that I was taking exams and moving house as of the time I was initially late. Those that stand for compassionate reasons enough? This is what I had said: " In my opinion. you can not switch into Tier-1 from within UK if you are on a WHM VISA and as Tier-1 is a single stage process, that means you cant apply for Tier-1 from withing UK . " I will make it easy for you to understand. The first part of the statement abo...

What does tier being a single stage process have to do with not being able to apply in country to switch. Why would that make a difference if it is one stage or 20? Where are you getting this from? FYI, this was in response to the part-II of the query of petenz, as below: I understand I would have ...

Re: Changing from working holiday to HSMP/Tier 1

Hello, I am considering entering the UK from NZ on a working holiday visa as the wait time is considerably shorter. If I was to enter with the working holiday visa, what would be involved in changing to the HSMP or Tier 1 while in the UK? I understand I would have to return to NZ at some point - wh...

Please refrain from making duplicate posts . Anyhow, did you make sure before applying that you could indeed apply for Tier 1 from within UK and switch from WHM category? The website and the policy guidance don't seem to list WHM as a switchable visa category. Or am I missing something here?? regar...

I just told you it wasn't. If you look at what they counted and what you have, deduction would tell you how they were counted. You clearly didn't read the guidance regarding how to calculate absences, perhaps you should proceed to review it before you run off half cocked and resumbit a bad applicat...

Try to get SAB file and see the details. what would you mean by SAB file? Also, are inbound & outbound days calculated towards absent days? I have counted them and come to the figure of 260 days. Also, if they are not going to reply to my request of reconsideration, I can reapply and submit the...

My total absence is 260 days, out of which 160 days was paid leave. That would leave 100 days overseas. However, HO rejected my application saying that I was overseas for 236 days. As a reminder, people should always copy their passport and the visas within them should you lose them, then it helps the authorities by giving them something to go on as a basis to replace the passport and visas.

Re: Working holiday maker - Extending stay

You will have to leave the country to do so. However most people can apply with an out of country applicaition and still remain in the country until the decision is made and then you will have to fly home and pickup the visa in your home country\ I hope that helps. Thanks for this advice. It's not ...
