@Thaman: I have driving conviction which went to court. I'm due to get ILR in may 2011. if these new rules be implemented then i wont be eligible for ilr. hope the new rules will not be implemented in april 2011 by gods grace. Hi York, am in the same boat...had drink & drive offence this month....

I got my hsmp in may 2006 (pre nov 2006) and my ilr is due in july 2011. however i might get driving ban in court (which is a criminal conviction for drink & drive) by march Now new rule change in april 2011 states that you shld not have unspent conviction for ILR. I believe there would be many ...

will these new rule for settlement apply to people who are on verge of settlement.

for e.g. conviction can happen anytime...traffic offence in court is a conviction, but then someone who is on verge of getting ILR will have all his years wasted?

Hi, I got a drink & drive offence last week and am awaiting court decision. But I might get a 12 month driving ban with some fine. My concern is that my ILR/PR is due in July 2011. Obviously my ban wouldn't be over by then. Will this have any negative effect on my ILR application? I got my hsmp ...

Well the ques originally was for T1 but I dont see any issue in discussing with members the effect the scenario might have on an ILR application! Forum is for disucssing any possible immigration topic...I am just trying to workout if the period of unemployement while on T1 will have ay effect on ILR...

So does this mean....when applying for ILR...if we have gap in employemet it will not be taken against us?

coz for ILR their is no salary points etc....in 5 years if I have a gap of 3 & 4 months separately i.e. not working & rest period employed...is it considered as negative?

when wass ur initial hsmp approved. if ur JR affected then u need to send 12 months payslips to show ur economic activity.

I think in the light of recent UKBA announcement on HSMP JR, there was a vacuum created as to how original HSMP extensions are handled now. I have sent my application(as of June 16th and no results yet) for extension according to new Tier 1 rules, but this would be handled under HSMP JR rules now. ...

well people are getting their hsmp extensions who applied in may end....recently someone spoke to HO & they said they are on 29th May 2008 date...probably their is a different queue for initial hsmp and another for extension cases....

hi As mentioned above....UKBA is expected to put up guidelines for HSMP extensions for Pre nov 2006 people in the week of 7th July 2008. And as per the JR....the old rules have to be considered. Therefore: 1. no english requirement. 2.no maintenance funds 3. no points. However, it is still to be see...

If you qualify under PBS Tier 1, why do you want to confuse the issue? I believe some one has had their application put on hold just for that very reason. hi thaman. i dont think that u should fill sec 3 c n specially if u r below 75...s what i think it might hit to their eyes.....if it was exceeding that i dont think there is ne harm..otherwise dont fill sec 3 at all n put the covering letter with JR conclusion... but still i will invite others to p...
