Re: IRP Registration County Cork

So you entered Ireland as a tourist? What rights are you entitled to for a resident permit (IRP) is what I meant by having a document/letter. You must be authorised with rights to remain in Ireland as a resident and than should be approved via a government (INIS/DoJ) document. The Garda immigration...

Re: Spouse EU Settlement

Even under the Appendix EU guidelines, The spouse needs to have a reasonable grounds for the late EUSS application and also needs to be excercising her rights under the old EEA regulations, thus have a EEA residence card/EEA family permit or EEA Permanent residence card.

Re: Spouse EU Settlement

Yes she needs to apply outside UK.. The duration of the marriage doesn't count now. She needed to be in the country before the deadline. Are you sure about that? As I understand it, if the EEA citizen partner is in the UK before 31st December 2020 (which they were because they have got pre-settled ...

Re: Spouse EU Settlement

Ok, and to apply for the Family Visa, does she need to leave the country ? There's no way to do it within the UK ? It is insane, we've been married for 32 years. Yes she needs to apply outside UK.. The duration of the marriage doesn't count now. She needed to be in the country before the de...

Re: Spouse EU Settlement

Were you married before or after 31st December 2020? You can only apply to stay with your family member if you have either: an EEA or EU Settlement Scheme family permit - you must apply within 3 months of arriving in the UK a residence card a valid visa - for example, a work, study or family visa I...

Re: Eu Treaty files waiting time - EU1 or EU1A

Hi everyone, i finally got an appointment to register my temporary irp in cork (after around 6+ months waiting) and was wondering how long the process is there? is it a quick process or will we be a while there? It depends on the queue you will meet there and the immigration guard. It normally take...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

By definition the marriage certificate is false. How could it be anything else when the marriage date is backdated. I would be inclined to pass the information on to the Home Office stating you were not married on the date of the certificate and that will end his legal stay in the U.K. He has clear...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

Advice from any source and particularly from a high percentage of the lower end immigration professionals is not always a reflection of the actual law. Just because an immigration lawyer has advised on a matter does not mean it is fully within the scope of the law. The Marriage Act is very particul...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

As you state - tier 4 / student visas are not gained through individual sponsorship. The ex partner may well have given him financial support to meet the fees of the co...

I also suspect you are not officially married in the legal sense. Proxy marriages even in Nigeria are classed as customary and require a formal register wedding to formalise the marriage. Taken from immigration case law - Proxy marriages can only be accepted as valid in Nigerian law if conducted un...

Re: EU family member residency card refusal

Hello everyone, Could you please give me an advice. I am an Irish citizen and moved to Spain. I have 2 dependant family members (my mother and daughter). They have been dependant on me for over 5 years and they got their first 5 year residency cards 6 years ago in Spain without any issues. Later, w...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

As Casa mentioned, Adultery can be a grounds to trigger legal separation earlier but you will need to really work on it properly preferably with a solicitor. Maybe your spouse is not aware he will not be deported and he can easily maintian his stay in UK even after divorce or separation with you, he...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

Firstly inform the Home Office the marriage is no longer subsisting and that will end his right to remain in the UK. You will be able to bring divorce proceedings in the UK. Talk to a family lawyer. You will need the wedding certificate though. He can’t stop you divorcing him nor can he slow the pr...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

There is no such rule that prevents an individual bringing in another partner/ spouse dependent after a divorce. So unless Angel99 can quote the law that they “believe” exists then it is safe to assume that is a falsehood. Since you and I are not immigration officers you can not claim someone's cas...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

The 5 years thing means you can not bring someone into the country or sponsor the person as a partner or spouse until 5 years. Not sure where you get this from? There is no such rule. There have been cases whereby after divorce the EU citizen/UK is not able to sponsor another person into the countr...

Re: EEA SPONSOR | PROXY MARRIAGE | DIVORCE

Hi, Your story doesn't addup. How did your spouse ex partner bring him into the country and runaway. Then next he is on a student permit which was due to expire. It's not easy for someone to be on a partnership status and change to a low status as a student in EU. It's almost impossible and would ta...

Re: Travel with EU family card whithout spouse

Now it's in force, EU family members with the residence card under the EU directive can travel alone. Your non-EU family member does not need a visa if they have a residence card. With this residence card (or permanent residence card) they can travel visa-free to all EU countries (including the coun...
