Re: Received SAR for travel dates, basic information missing

I guess you need to send an email with additional evidence, attach a cover note and try your luck. Though I should add, if you know you have been out of the UK and are basing switching route on the fact that the HO won't find out, it is a gamble that you are not necessarily going to win. 1. I don't...

Re: Received SAR for travel dates, basic information missing

No need to do that. It possibly wouldn't even be read by the case worker. If they need more documents they will contact you, you supplied everything you needed to. Did you indicate you were applying under Section 6(1) or 6(2)? You have to pick one, I imagine you picked the 3 year route as it was mo...

Re: Received SAR for travel dates, basic information missing

As my BC application is in process, and having gone over my SAR and discovering new data, I want to send an update message to the case worker What is the process for this? I applied under three-year route, but having compiled now my 5 year route travel, I would like to (politely) offer the HO to con...

SAR results are notoriously incomplete.
Is it meant to be only commercial carrier data (complete or not) and nothing on entrances to the UK? Or did I just fall between the cracks on this one?

Do case workers have the same data as SAR?

Received SAR for travel dates, basic information missing

I requested 5 years of basic travel information. I received a lot of data from the commercial carriers I flew on. That data is helpful but far from complete, many trips missing, trips that I checked in for, but ultimately didn't fly etc. it helps with leaving the UK info as there are no exit border ...

Re: Over 90 days in last 12 months, is there discretion?

The guidance clearly says "only if all other requirements are met" which to me means they didn't get disregarded, but that you actually meet them as they have been set out. Not all mods comment on every post, especially if they agree with the advice that was given. Contorted_svy, I have a...

Re: Over 90 days in last 12 months, is there discretion?

If you ask for discretion on one requirement it means you didn't fullfil it (hence the request for discretion). I would argue, regardless whether it can be demonstrated that your job requires travel or not, that you are still not meeting both requirements - for one you are just over the limit so it...

Re: Over 90 days in last 12 months, is there discretion?

As I said, I wouldn't know how to make the case for it. That being said, I think it would apply if you are over one of the two requirements (eg under 90 days in the last year but over 270 days in three years, or the other way around). I wouldn't recommend applying if you are up to 100 and 300 days ...

Re: Over 90 days in last 12 months, is there discretion?

So let me understand. There is (potential as always) discretion if you are over either 90 or 270. If its up to (again, either) 100 or 300 they typically give discretion. Over (either) 100/300 you must have everything else in place. So where does the "unavoidable consequence of the nature of you...

Re: Over 90 days in last 12 months, is there discretion?

1. I am confused on the basics, for what exactly is this specific point of discretion good for? It seems to cover only over 270/450 nothing to do with 90? IF you fit into this discretion (i.e. accepted by the caseworker), does it cover the double whammy of over 90 and over 270? 2. Besides the short ...

In my case (over 90 days in last 12 months AND over 270, albeit less than 300 in 3Y) does the following help my case in any way: "the excess absences were an unavoidable consequence of the nature of the applicant’s career, such as a merchant seaman or employment with a multinational company bas...

Re: Over 90 days in last 12 months, is there discretion?

Once you submit and pay, that is the defining date for application (e.g. absences calculation)? You can immediately travel (but have to be back for the UKCVAS appointment)? What is the time deadline to get an appointment done (28 days? or longer?)? You can continue making changes to evidence documen...

Re: Over 90 days in last 12 months, is there discretion?

You are free to travel after submitting application, but biometrics and ceremony need to be done in the UK. You are still an ILR holder with BRP until you are British - naturalisation isn't part of the immigration framework. Don't you have to book an appointment with UKVAS to verify the passports (...

Re: Over 90 days in last 12 months, is there discretion?

1. I have inserted my list of travels and I am at 30 trips and the form won't let me add more, is this standard form limit? (Can I add the rest manually in a cover letter? Is there opportunity to upload a cover letter in general to give some context, e.g. why I travel a lot?) 2. It asks for previous...
