citizenship applications are not immigration applications - if child's visa expires section 3c doesn't apply, so she won't have a valid immigration status.
So we have to extend her visa firstly to let her go to school and then register her the citizenship?

Re: Tier 2 dependent extension

Leave will lapse , if an absence exceeds 2 years. May I ask if you are referring to indefinite leave to remain (ILR) or a spouse visa? Have you clicked the linked provided?? Key is the word "lapse"!! Yes. We won’t leave UK for 2 years. This is why my focus is on continuous 5 years.

Re: Tier 2 dependent extension

Thinking out loud - maybe he can switch to family visa in this case? That's usually bad advice, but AFAIK it has barely any, if not none, absence limits, allowing your husband to qualify for ILR in 5 years. Other, more experienced folks, will give better advice - wait for their response. Thank you ...

Re: Clarification on Child's Visa Status During Citizenship Application

She will be fine for schooling. No need to extend her visa, just plan accordingly for medical insurance etc. The school contacted us that they will need some formal evidence of my daughter’s right to live and study in the UK whilst her application is being processed. They said the Home Office may i...

Re: Clarification on Child's Visa Status During Citizenship Application

Does anyone knows that whether submitting the citizenship application before her visa expiration date allows her to remain legally in the UK while we await a decision on her application? No it does not. Citizenship is NOT an immigration application. Once her visa expires, she becomes an overstayer ...

Hi, I have received my ILR (5-year Tier 2) today, and my child was born in the UK. I am planning to apply for citizenship for her, as her current Tier 2 dependant visa will expire on 13th October. Tier 2 dependent extension

Hi, I have received my ILR (5-year Tier 2) today. Over the past 5 years, my husband and child have been my dependants, and my child has been living with me in the UK during this time. However, my husband is not eligible for ILR due to spending more than 180 days outside the UK each year for work. I ...

Re: ILR for children born in UK with only one parent is ILR

Fortunately, UK-born children are also entitled to register directly for British citizenship immediately after a parent has ILR. They themselves may skip ILR when registering for British citizenship. OP doesn't want to register kids as British. I'm guessing it might have to do with losing Chinese c...

Re: ILR for children born in UK with only one parent is ILR

The children normally can only settle when both parents are settled, so they will settle when your husband settles. They may get ILR via the private life route after 7 years of living in the UK: https://www.immigrationboards.com/indefinite-leave-to-remain/ilr-for-7-years-old-uk-born-child-t332032.h...

Re: ILR for children born in UK with only one parent is ILR

Thank you. Then that means my kids and my husband can apply for spouse visa and then apply for ILR in the future. Thank you for the reply. Thank you for the reply. My friend told me even though there’s no absence limit for spouse visa, but if you are not in UK more than 180 days in any roll year, it’s very likely to be refused when you apply for the ILR. Is it true? Thank you change to Spouse visa, is that true? Yes. If my husband chan...

Re: ILR for children born in UK with only one parent is ILR

Thank you for your reply. I checked the government website, it seems that after I get ILR, my husband and my kids can continue renew their tier 2 dependent visa or change to Spouse visa, is that true? Re: Tier 2 dependent 180 days enquiry

Thank you for your answer. My husband won't be qualified since he won't be UK for more than 180 day in continuous 5 years. Does that mean they will be Tier 2 dependents for ever?
thank you
