The problem is we didn't realize he had to leave, and now we don't have the money and he's now an over stayer. So yeah.. one big mess.. but then that's nothing new, it's been one big mess for a long time.

Does anyone know if he has to return for sure, with him being on a visitors visa, would he need to re-enter to switch it to a spouse visa?

I don't think that he can send passport from the UK to the USA to get it endorsed . As he has a child, he may argue that it's disproportionate for him to return to the USA to get the spouse visa endorsed. However, then they may grant him discretionary leave instead of FLR(M) (see case laws on 284 a...

hi Mags, so can you clarify a bit, you guys applied for the spouse visa even though your partner was in the UK on a visitors visa? Hello. No, he applied for the spouse visa from the US and was refused. While waiting on the appeal coming up, he came over here on a visitors visa and was here when his...

Hello again :) so after a long 9 months, he won the appeal :) Wasn't too bad because he's been here for the last 5 and a half months on a visitors visa. The problem with that is he's to send his passport to New York to get it stamped, will he need to travel back to the US, or can he send it from her...

I'm looking to move over to the states with my family, my husband is an American citizen living in the UK on a spouse visa, we have been married two years and have two kids together. From what I can gather it's a complicated procedure (major sore head!) I was looking to hear from people who have bee...

Plenty more forms for US immigration too I'm afraid and a lot of dollars also. The US immigration process is tougher too in my book having seen some of my friends go through it. *Big sigh* I know, I know.. and it's something I'm totally clueless about right now. We were married in America, would th...

Well, the plan has taken a big u-turn. We wanted to move over to the States, just isn't working for us here in Scotland.. so instead of wasting more money here.. he's just going back :( He has work over there with his father and although it may take months, I'll eventually join him.. ugh.. I'm going...

Hmm.. no he hasn't, I didn't realize he had to. So we wouldn't have been able to apply for settlement anyway.. Well, we are going to try and raise the money for the extension through family and possible a loan, which isn't ideal because that means he still can't claim for his children and if granted...

Income support and tax credits. It's not looking good, and me at my worst I've left it all to the last minute :( we are stuck in between a rock and a hard place, because if he has to go back to the States, we don't even have money for a ticket, but at the same time don't have money for him to stay. ...

It's £820 now... Baby makes no difference I'm afraid. There's no free way, the Family Reunion thing i think is for asylum seekers, nice isn't it? Options are; 1. bite the bullet. 2. extend the spouse visa, only puts off the inevitable tho. 3. relocate to Europe, exercise a treaty right by doing so...

Ok, here goes.. My husband (I'm a UK citizen, he's American) is over in the UK on a spouse visa, which ends on the first of May 2010. He has been out of work for several months and unable to claim any benefits, so needless to say, we are totally skint. I believe the settlement costs £750? and we ju...

Only you can sponsor ur husband, no alternative. I think you'll have to find a job after the birth to show some income, look at it from the ECO's view; lone parent not working bringing over someone else who is not working... Yes, that's the plan.. but I'm worried they wont take that into account at...
