your solicitor has advised you of the two possible outcomes. He/she is in the best position to advise you of the likely outcome and he/she knows all of the facts of your case. I don't think speculation will help you. Just wait and see what happens.

See Immigration Rules, para 245c(f). To be granted leave to remain under Tier 1 General you must last have been given leave to remain in one of the categories listed in this paragraph.

i think by using your Canadian passport they might think you are trying to be deceptive. Why not use your US passport since US citizens are also non-visa nationals?

there's no 28 day grace period automatic or otherwise. if you visa expires on a certain date you need to leave by that date unless you qualify and apply for leave in another category. The ban only kicks in when you apply for entry clearance. Theres nothing to stop you from applying but you will be refused.

If you apply again you will be refused for the same reasons and probably subjected to a mandatory ban under paragraph 320 (7A).
