Tell the truth, and apologise for not telling them earlier. If your partner does not work your HB/LHA will not be affected.

The requirement for all parties on a HB/LHA claim to have a national insurance number was removed in April - get the to check their regs. I'm away from home at the moment so unfortunately I don't have the exact reference to hand.

The lawyer is wrong, you absolutely claim Housing Benefit/Local Housing Allowance if you meet the income criteria. You are not allowed to get a higher rate of benefit because your wife is living with you, but this is not a problem as the Housing Benefit/LHA rates for a single person with no children...

Thanks, RiFF, I really appreciate your taking the time to reply. We had a long talk last night, and taking into account the approval times some people are reporting, we'll probably go for the Spouse visa from Canada. Gonna be hard though :(
