Can a EEA apply for ILR

I have seen this question answered before, but it was before the referendum. The answer was generally to ask for a DCPR. Is it possible for a EEA citizen to apply for ILR, as opposed to a DCPR? And more specifically, would a EEA citizen married with a British citizen be able to apply for ILR, if the...

Re: UK to leave EU - Surinder Singh consequences?

I’m sure their entry would be covered under Article 8. This is likely to be the view of the ECJ as the UK will not be withdrawing from the Human Rights Act. This argument has already been made and failed. The counter argument being that the UK citizen can always go live with their spouse in the spo...

Re: British Passport renewal of children of EEA citizens wit

CSI for students has been a legal requirement since 2000. My own sister moved in the UK as a EU student in 1999. She wouldn't be able to use that as she has been out of the country twice for more than 2 years afterwards, breaking the continuity of residence, but it is not impossible there may be ot...

Re: British Passport renewal of children of EEA citizens wit

What are parents' nationalities? Thank you for your answers, really helpful and informative. One of the A8 countries, they may be from Poland. EC rights exercised before date of accession can help acquire PR. Not sure if this holds if only part of the 5 year period was completed before accession. Z...

Re: British Passport renewal of children of EEA citizens wit

I was renewing my kids passports second half of the last year and they did't request no other documentation than current passport. They may have adopted this policy of reviewing the passport renewals of settled East European citizens after that. Alternatively, if the policy was already in place, th...

Re: British Passport renewal of children of EEA citizens wit

It is worth bearing in mind that both a letter confirming British nationality status and a British passport are only prima facie proof of citizenship, not conclusive proof when it comes to proving British citizenship. There is, to the best of my knowledge, no conclusive proof of British citizenship...

Re: British Passport renewal of children of EEA citizens wit

Should the parents pay £198 per children to request the Home Office to provide them with a Confirmation of status as a British citizen" through the form NS? I fear it makes sense. It will be easier to look after than a bundle of documents, and there will be no problem with the bundle being spl...

Re: Can an underage student be a QP and a sponsor

How is child exercising treaty rights? As a student. Both parent and child have their own EEA country issued valid EHIC, and have been here for almost 1 year. A dependent parent would have to prove dependency on EEA sponsor (child) for their essential needs (housing, food). Is that the case? No, th...

Can an underage student be a QP and a sponsor

Can an EEA underage student be a qualified person and sponsor the EEA(FM) application of one of their parents? Or could be more advisable for the parent to apply as a self sufficient qualified person instead, and sponsor the EEA(FM) application of the child? I guess for both options they may need CS...

I would be very surprised if that would not be the case.

In a hostile divorce scenario, the European citizens will become collateral damage.

Re: Children born in UK before mother's UKM registration

When were the children born in the UK ? 2004 and 2007. Given the answers above (thanks to everyone), it looks like for the 2004 child the only available avenues are registration through MN1 or T, while the other one should already be a citizen by birth. As a side note, my view is that the current l...

Children born in UK before mother's UKM registration

The grandmother's children were born in Italy, and gained Italian citizenship at birth through their father, the grandfather. Can a person with a eea rc just apply anyway like any eu national ( with exeptions) or british? How does it work? In the section where you fill your parents' details, you can see a note on right hand side stating requirements of your grandparents' details. Well, I filled 3 forms so far (for people who got the BC through naturalisation), and I never noticed that note, I never wrote down my grandparents' details...

Yup, just to confirm, my wife has a first name made of 2 words separated by a space, and a last name made of 2 words separated by a space, following this schema:

FFF FFF LLL LLL

And the UKBA got it right, no dashes.
