VT, the law changed last April and it is no longer necessary for your partner to have NI number. The legislation is The Social Security (National Insurance Number Information: Exemption) Regulations 2009 . They sent my parent a form asking what is national insurance number is or if he didn't have one then why he didn't have a national insurance number. Either to fill out the form or call. Thank you for the verification. So he must be on the claim but does not need the national insurance number they say he must have. They already admitted to me that they have 'never come across a situation like this' which seems slightly bizarre! That said, I was just worried that they'd make be do so...

Can someone Please find this information somewhere official? I have looked and can't find any regulations officially. I'm afraid if I lose housing benefit he'll have to go back to the US after the wedding, because he'd be supporting me not the other way around! I'm so stressed/ worried about wedding...

As long as you can prove you can support him without claiming anyMORE benefit and/or he has enough savings to support himself you'll be okay. I am in the exact same situation and my fiance got his visa from the US in June, our wedding is in October so we haven't gone through the transfer of visa yet...

It took new york 24 hours to decide to grant the first visa so fingers crossed for the next one. So he's allowed to stay while they make their mind up. Thats good. If you know, can you go for a in person application if your application includes info on benefits? Thanks for your time. It never ceases...

3 months?! Oh no! But his 6 months will be up by then if it takes 3 months for the next visa.
I am under the impression that we cannot apply in person as it's not a straight forward case.(he has enough savings to support himself but i get housing benefit and working tax credit)
