Do you think I’m able to obtain my retention of right of residence? If your answer is yes, what should I do just now? Keep it quiet or inform the HO? And when should I apply for PR? And what should I do if I travel abroad on way back into the UK? Hi there. I would guess that you would be able to ...

2 weeks later, I received post from the HO enclosing 2 letters: the first one was an apology about the confusion and explaning that they haven't got viniettes that reflect my new status hence they used the resident card. M Amazing - the HO saying one thing to me and a totally different thing to you...

He is an EEA member so doesn't have a residence card. I seem to remember sending his passport to them when I originally applied for a residence card as his spouse.

i cant remember if she gave them her ex passport. I didn't. I did however send an old photocopy of it with my original application. I don't see why they would need it though as any original residence card would have needed it submitted to begin with. In addition I think it would be highly unreasona...

Hi datuchi Logic would imply that once you retain your rights then the assumption is your parents would as well. If you look at the eea2 and eea4 forms, there is a sections to include other family members in the application. I would ring the bia if i was you( try and speak to more than 5 advisors) ...

Looks all good. Finally. I complained about the endorsement that was put in my passport to which they replied was indeed the wrong one. I then returned my passport with a covering letter which stated that perhaps I was due PR due to my marriage being in 2003. My solicitor mailed me this morning to s...

Please do keep us updated with things. It really is a very complicated system and the caseworkers seem to not have any room for using their own initiative. It's almost like they have a flowchart and have to follow it no matter what! Crazy. I can only guess that your case and application for PR after...

That's awful news Isceon. If it's just a matter of them not having ID of the ex it's ridiculous. They obviously had that ID to grant an initial residence card! Sounds like they've got confused somewhere along the line (wouldn't surprise me). I would get a good solicitor. I think the only good thing ...

That's not the issue. I just hope the immigration officials at the airport are happy to see the residence card in my old passport whilst I use my new one. I heard some people staple them together and do it that way. Don't staple together if you have biometric passports though! I'm sure my new one w...

Juicy Busicit, One other question. In it's new photo and sticker format, did the new Residence Card have your name on it, or did it still have the name of your ex-husband as the family member? Regards, H. Yes - it's the new photo sticker format. No actual name of ex-family member is on it. It does ...

I applied for a residence card using the EEA4 form. Not sure why I couldn't get PR - perhaps it was due to me applying simply to retain my existing rights? My passport with the new card in has now expired. I really hope this doesn't cause me headaches as I was hoping to attach it to my new one (that...

An update FINALLY. I finally got my documents back (13 months after sending them away). Totally conflicting info from what I was advised. One time I even rang up the HO to be told that I could travel after getting divorced but would have to take all the evidence regarding my ex-husband exercising treaty rights plus my wage slips with me to show immigration people at the airport!

It's a very grey area. I sent on all possible documents I could possibly find. My ex-husband would only grant me access to certain documents and during our time married we never had a joint account / bills in my name. Hopefully what I sent was enough. They never once requested an original passport f...

Another update. Over one year and still no decision on my case. I have complained to the NWCSU and received a letter stating that my case was now under 'priority consideration' with a case worker and that a decision was expected 'imminently'. Still no time frame though. Anyone had a similar letter a...

No word still - ONE YEAR ON! I know it is a disgrace, but I am not really surprised. Even the simple applications are taking 8 or 9 months, so I am sure that complicated cases are not a high priority right now. Have you considered complaining to someone outside of the UKBA? I think you can contact ...

Also, I'm not sure if you know but do the HO generally require passports to grant residency at the moment it's granted? They've had mine since Dec 2007 so surely if there's not going to be a physical stamp in it then we won't require it? Any ideas? I read Morpheos posts (link above) and it seems ve...
